The Association “Self-regulatory organization of appraisers “Expert Council” was created as a result of numerous initiatives of appraisers from various regions of Russia and already unites over 2,400 Appraisers.

The Association takes an active position in the appraisal industry. This is an association of people interested in developing appraisal activities in Russia, improving the quality of appraisal services, the role of regions, the status and respect of the Appraiser profession. The Association was created and organizes its work taking into account the best positive experience, as well as mistakes and shortcomings of other self-regulatory organizations of appraisers. Members of the Association receive uniform, clear rules for work and control over appraisal activities, as well as a real opportunity for expert and methodological support in their work and in the event of conflicts and proceedings.

December 25, 2019 Results of the first in-person session of students of the master's program in forensic science

On December 17-23, the first full-time session of the master's program “Forensic Financial and Economic Expertise” (direction - jurisprudence) took place. Master's programs are implemented using the online form of REU named after. G.V. Plekhanov and the Union of Forensic Experts “Expert Council”.

The first group of masters includes 60 students from 19 regions of Russia. Traditionally, the in-person session was held at the Lesnye Dali health and sports boarding house of the Administration of the President of the Russian Federation.

The Expert Council continues to improve educational technologies that are used in the implementation of master's programs. In particular, webinars were held with the face-to-face participation of teachers and students from the Moscow region. During the first semester, methodological material was transmitted in the form of webinars. The face-to-face session was aimed at developing the necessary practical skills based on interaction between the Program participants.

Interactive Forms, multi-format tasks - all participants noted the richness of the session program. It included the following blocks:

psychological training “Expert resilience”;

psychological training “Psychology of behavior in litigation”;

business game "Litigation".

The psychological training “Expert resilience (three axes: task, relationships, energy)” was conducted by professional social psychologist (MSU), certified business coach, international NLP trainer Tatyana Muzhitskaya. Participants examined such components of the topic as real tools that can be used to measure and change the situation in a 3D communication model; tasks (metamodel, logical levels); relationships (relationships, technologists, authorities); tools of dissociation, reframing, self-esteem.

Co-founder of Soft Skills Law Academy, business coach, NLP practitioner Anna Sorokina conducted a psychological training “Psychology of Behavior in Litigation,” where she spoke about the communication field of a trial lawyer, the types and main subjects of communication, communication mistakes of a lawyer, and revealed the secrets of establishing contact with a judge (how to become a trusted lawyer). The participants examined the types of judges and the features of communication with different types, touched upon the topic of emotional intelligence of a trial lawyer, practiced skills to increase resistance to negative emotions and aggression, and performed a number of exercises to increase confidence and regulate the emotional background of the process.

Chairman of the Board of the NP “College of Auditors, Experts and Specialists” Alexander Aleshin discussed with the session participants the topic “Interrogation of a forensic expert. Justification of the expert’s position, work with case materials,” revealing important aspects of the interrogation and interaction of the forensic expert with the investigation to obtain additional objects of research, and also spoke about the development of the methodology of forensic financial and economic examination.

The discussion was attended by Irina Mikhailovna Filippova, Deputy Director of the Department of Financial and Banking Activities and Investment Development of the Ministry of Economic Development of the Russian Federation and Alexey Sergeevich Bunkin, Director of the Federal Resource Center for Organization of Management Training.

According to the speaker, the situation is similar to that if academicians were forced to take the Unified State Exam, and if they scored fewer points than school graduates, they would be deprived of their title.

The President of the Association noted that the problems of the exam concern not only members of the assessment community, which numbers about 22,000 Appraisers. Taking into account related specialists, about 100,000 jobs have been created in the appraisal field.

A significant problem lies in the extremely low intensity of taking the qualification exam. At the moment, about 600 Appraisers have passed the qualification exam, which is no more than 3% of their total number. At the same time, the quantitypreliminary applications for the organization of qualification examinations in the constituent entities of the Russian Federation exceeded 9,000! According to A.V. Kaminsky, with such an organization, more than 80% of Appraisers, mostly regional, will not have the physical ability to pass the exam before the deadline and, as a result, will be forced to leave the profession. In turn, this will lead to an increase in the cost of appraisal services for the population and a deterioration in the economic microclimate for business.

The speaker drew attention to the delay in the start of the exam by more than 8 months. The exam should have started to be held from the beginning of 2017 so that appraisers joining the SROO in 2017, in accordance with 172-FZ, could have a qualification certificate by 07/01/2017. The first exam was held on August 21, and the first qualifying certificate was issued only on September 13. In fact, an action of civil disobedience is now being carried out, since none of the SROOs exclude appraisers who do not meet the requirements of 172-FZ for having a qualification certificate. A.V. Kaminsky emphasized the need to improve the procedure and content of the qualification exam: “What is this? Are we seeing Agile at the state level? Or is this unprofessionalism on the scale of industry management?”

According to the President of the Association, it is necessary to postpone the exam date from 07/01/2017 and 04/01/2018 to 01/01/2019. This measure will make it possible to develop systematic proposals for amending legislation, incl. to the relevant order of the Ministry of Economic Development No. 257 on the procedure for conducting the exam, as well as prepare the infrastructure for taking the exam in the regions.

LLC “Expert Council” organized a series of educational and discussion events in various regions for the Association “Self-regulatory organization of appraisers “Expert Council”. The issues of professional valuation activity in its various manifestations were discussed: changes in legislation, current issues of real estate valuation, the safety of the Appraiser and preparation for the qualification exam. REGULATIONS ON THE EXPERT COUNCIL
SELF-REGULATORY ORGANIZATION
"UNION "FEDERATION OF SPECIALISTS APPRAISERS"
(new edition)

1. GENERAL PROVISIONS

1.1. This Regulation on the Expert Council of the self-regulatory organization “Union “Federation of Appraiser Specialists” (hereinafter referred to as the Union) has been developed in accordance with Federal law dated July 29, 1998 No. 135-FZ “On valuation activities in Russian Federation"(hereinafter referred to as the Law on Valuation Activities), other regulatory legal acts of the Russian Federation, the Charter of the Union and other internal documents of the Union.
1.2. This Regulation establishes the status, purpose of activity, competence and structure of the Expert Council of the Union (hereinafter referred to as the Expert Council).
1.3. The Expert Council is a body of a self-regulatory organization of appraisers, created to provide the function of carrying out the examination of reports on the assessment of objects of assessment (hereinafter referred to as the assessment report).
1.4. The Expert Council in its activities is guided by the norms of the current legislation of the Russian Federation in the field of appraisal activities, including Federal Law No. 135-FZ dated July 29, 1998 “On appraisal activities in the Russian Federation”, Federal appraisal standards, regulations authorized federal body performing the functions of legal regulation of valuation activities, as well as internal regulatory documents Union.

2. COMPETENCE OF THE EXPERT COUNCIL

2.1. The competence of the Expert Council includes:
2.1.1. development of uniform requirements for the examination of assessment reports, working conditions for members of the Expert Council and their qualifications;
2.1.2. conducting an examination of assessment reports;
2.1.3. providing consulting, methodological and other assistance to subjects of valuation activities, customers of services for valuation and examination of valuation reports, as well as other persons;
2.1.4. other issues related to the activities of the Expert Council.
2.2. The procedure for conducting an examination of assessment reports is established in the standards and rules of the Union.
2.3. The Expert Council carries out its activities in cooperation with the Disciplinary Committee and the Union Control Department, as well as other bodies and structural divisions Union.

3. STRUCTURE AND PROCEDURE FOR FORMING THE EXPERT COUNCIL

3.1. Issues of the formation of the Expert Council, early termination of the powers of the Expert Council or early termination, as well as the election of its individual members fall within the exclusive competence of the General Meeting of Members of the Union.
The exclusive competence of the Council of the Union includes:
- approval of the Regulations on the Expert Council, amendments and additions to these Regulations;
- approval (establishment) of additional requirements for members of the Expert Council;
- performance General meeting members of the Union of candidates for election to members of the Expert Council of the Union;
- suspension of the activities of members of the Expert Council in the manner prescribed by the internal documents of the Union.
3.2. The Expert Council is formed from members of the Union consisting of at least 7 (Seven) people.
3.3. The term of office of members of the Expert Council is 5 (Five) years from the date of formation. Members of the Expert Council may be re-elected to the Expert Council an unlimited number of times.
3.4. Members of the Expert Council may be members of the Union who meet the requirements of the current legislation of the Russian Federation and additional requirements of the Union for members of the Expert Council.
3.5. The Expert Council is headed by the Chairman of the Expert Council.
3.6. The Chairman of the Expert Council and the Deputy Chairman of the Expert Council are approved by the Council of the Union from among the members of the Expert Council.
3.7. The Chairman of the Expert Council appoints the Secretary of the Expert Council from among the members of the Expert Council.
3.8. Identification of the fact of non-compliance of a member of the Expert Council with the requirements of the Law on Valuation Activities, these Regulations, is the basis for applying disciplinary measures in the manner prescribed by the Law on Valuation Activities, acts of the authorized federal body exercising the functions of legal regulation of valuation activities, other regulatory legal acts of the Russian Federation. 4. PRESIDIUM OF THE EXPERT COUNCIL

4.1. The Presidium of the Expert Council (hereinafter referred to as the Presidium) is a collegial working body of the Expert Council.
4.2. The competence of the Presidium includes:
- development and submission for consideration of the Council of the Union of draft documents on the activities of the Expert Council;
- making a decision to conduct unscheduled inspection a member of the Expert Council who does not meet the requirements of the Law on Valuation Activities, these Regulations, in the manner established by the current legislation of the Russian Federation, regulatory legal acts of the Russian Federation, internal documents of the Union;
- temporary suspension of members of the Expert Council from conducting examinations of assessment reports in the event of detection of violations in their activities;
- consideration of appeals against expert opinions signed by members of the Expert Council;
- other issues provided for by the legislation of the Russian Federation, Federal Valuation Standards, other regulatory legal acts of the Russian Federation, as well as internal documents of the Union.
4.3. The Presidium is formed by the Council of the Union from among the members of the Expert Council for a period equal to the term of office of the Expert Council. The numerical composition of the Presidium of the Expert Council is determined by the Council of the Union.
4.4. The Presidium is headed by the Chairman of the Expert Council. The Chairman chairs the meetings of the Presidium, and in his absence, the meetings of the Presidium are chaired by the Deputy Chairman of the Expert Council.
4.5. The Presidium of the Expert Council meets as needed.
4.6. Only members of the Presidium, the secretary of the Expert Council and persons invited by the Chairman of the Expert Council participate in meetings of the Presidium of the Expert Council.
4.7. A member of the Presidium of the Expert Council may participate in a meeting of the Presidium in person or through his representative. The representative must necessarily be a member of the Presidium of the Expert Council, and his right to represent interests must be confirmed by a notarized power of attorney.
4.8. A meeting of the Presidium of the Expert Council is valid if more than half of the members of the Presidium are present.
4.9. Decisions of the Presidium of the Expert Council are made by a simple majority of votes of the Presidium members present at the meeting.

5. MEETINGS OF THE EXPERT COUNCIL

5.1. Meetings of the Expert Council are held as necessary, at the initiative of the Chairman of the Expert Council or the governing bodies of the Union.
5.2. Members of the Expert Council, as well as consultants and other persons involved in its work, take part in meetings of the Expert Council.
5.3. A member of the Expert Council may participate in a meeting of the Expert Council in person or through his representative. The representative must be a member of the Expert Council, and his right to represent interests must be confirmed by a notarized power of attorney.
5.4. Decisions of the Expert Council are made by a simple majority of votes of the members of the Expert Council present at the meeting.

6. RIGHTS, DUTIES AND RESPONSIBILITIES OF MEMBERS OF THE EXPERT COUNCIL

6.1. Members of the Expert Council, if they are involved as experts for the examination of assessment reports, are required to conduct such an examination or motivate the refusal to conduct it.
6.2. Members of the Expert Council are obliged to:
- comply with the requirements of legislation in the field of appraisal activities, the Procedure for conducting an examination of assessment reports of the Union, these Regulations and other internal documents of the Union;
- take part in the activities of the Expert Council, including meetings of the Expert Council;
- carry out the instructions of the Chairman of the Expert Council and his Deputy within the framework of their powers, including conducting an examination of assessment reports, as well as providing members of the Union and other persons with explanations on issues related to the examination of assessment reports;
- testify in court on the examination performed on the basis of a court ruling;
- refuse to conduct an examination of the assessment report if circumstances arise (including at the stage of the examination) that impede an objective examination of the assessment report, as well as in the event of insufficient professional qualifications;
- ensure the safety of documents received from the customer for the examination of the assessment report and third parties during the examination, in accordance with the Procedure for conducting the examination of assessment reports of the Union;
- conduct a full study of the provided materials, give an objective and substantiated expert opinion on the questions raised;
- indicate in the expert report the rationale for the conclusion based on the results of the examination of the assessment report, confirming the conclusion made;
- provide explanations on issues related to the examination and on the expert opinion;
- notify the executive bodies of the Union about the facts of influence on it by any persons in order to influence the conclusion (conclusions) contained in the expert opinion;
- maintain the confidentiality of information that became known to him in connection with the examination of the assessment report, except for cases provided for by the legislation of the Russian Federation;
- comply with other requirements provided for by the current legislation of the Russian Federation.
6.3. Members of the Expert Council have the right:
- get acquainted with materials related to the subject of the examination, extract from them necessary information or make copies;
- request from the customer of the examination and third parties the information necessary to carry out the examination of the assessment report;
- notify the appraiser before the transfer of the expert opinion to the customer about the results of the examination of the appraisal report signed by him, if this does not contradict the terms of the contract for examination;
- declare the need to involve other experts in the examination;
- appeal is in order, established by law Russian Federation, actions that violate the rights of a member of the Expert Council;
- carry out other actions provided for by the legislation of the Russian Federation, Federal Valuation Standards, other regulatory legal acts of the Russian Federation and internal documents of the Association.
6.4. Members of the Expert Council are not entitled to:
- carry out an examination of assessment reports if activities as an expert are suspended by decision of the Council of the Union in the manner established by the current legislation of the Russian Federation, regulations of the Russian Federation, internal documents of the Union;
- enter into personal contacts with persons interested in the results of the examination on issues related to the conduct of the examination, calling into question his disinterest in its results;
- use information that became known during the examination of assessment reports for personal purposes;
- perform other actions, the prohibition of which is provided for by the legislation of the Russian Federation in the field of valuation activities and internal documents of the Union.
6.5. Actions (inaction) of the expert or experts of the Union during the examination of the report, as well as the results of the examination, can be appealed by interested parties to the Union in the manner and within the time limits established by the authorized federal body, performing the functions of legal regulation of valuation activities, or challenged in court.
6.6. Influence on the Union expert by the body or person on whose initiative the examination is carried out, appraisers who participated in the preparation of the assessment report, judges, as well as any bodies, organizations, associations and other persons interested in the outcome of the examination is not allowed.
6.7. The Union, having compensated for losses caused to the customer who entered into an assessment agreement, or property damage caused to third parties by the actions (inaction) of the appraiser or appraisers as a result of what was established by the court, arbitration court in accordance with the established jurisdiction, the arbitration tribunal has the right of recourse to the expert (experts) who signed the ) the specified expert opinion.

7. PROCEDURE FOR AMENDING THE REGULATIONS ON THE EXPERT COUNCIL

7.1. Changes to these Regulations are made in accordance with the current legislation of the Russian Federation and internal documents of the Union.

8. FINAL PROVISIONS

8.1. Issues not regulated by these Regulations are resolved in the manner prescribed by the legislation of the Russian Federation and internal documents of the Union.
