Basic principles of remuneration

The work of teachers is regulated by Ch. 52 of the Labor Code of the Russian Federation, and the procedure for its payment is described in the Unified Recommendations for the establishment at the federal, regional and local levels of remuneration systems for employees of state and municipal institutions for 2017, approved by the Decision of the Tripartite Commission for the Regulation of Social and Labor Relations dated December 23, 2016 (Minutes No. 11). The document establishes the basic principles of remuneration for employees of educational institutions. Let's list them:

  • it is impossible for wages to deteriorate in comparison with those established at the legislative level;
  • wages are fixed both at the legislative level and at the local level;
  • wages depend on the qualifications of the employee and the complexity of the functions performed;
  • the calculation takes into account the quantity and quality of labor expended;
  • remuneration for work of equal value must be the same; discrimination in the field of remuneration is not allowed, including when establishing additional payments of a different nature;
  • increase in real wages;
  • provision of other guarantees of remuneration, enshrined in labor legislation.

When calculating wages, management must take into account the provisions of Art. 133 of the Labor Code of the Russian Federation: an employee’s salary cannot be lower than the minimum wage if he has fulfilled his labor standard. The employer should also keep in mind such factors as working conditions and the teacher’s area of ​​residence. If the educational institution is located in an area with special climatic conditions or the teacher has to work in dangerous or harmful conditions, the management is obliged to pay an increased salary (Article 147, Article 315 of the Labor Code of the Russian Federation).

Calculating a teacher's salary

A teacher’s salary consists of several components:

  • wage rate;
  • incentive payments;
  • coefficients established by the Labor Code of the Russian Federation;
  • additional payments for performing additional work.

Clause 37 of the Unified Recommendations establishes the percentage ratio of salary and additional payments in the education system. The teacher's salary should be at least 55-60% of the full salary. In educational institutions, the recommended percentage should be as follows: 70% - salary, 30% - additional payments.

When calculating the salary, the employer must take into account the standard hours for the year or week and indicate it in the employment contract. It was established by the order of the Ministry of Education and Science of the Russian Federation “On the duration of working hours teaching staff..." dated December 22, 2014 No. 1601. The maximum weekly rate for such workers is 36 hours, and the annual rate is 720 hours. For some categories of teachers it is even lower. For example, 30 hours - for physical education teachers, 18 hours - for teachers additional education, speech therapists, teachers foreign language in preschool educational institutions, etc. In accordance with Appendix 1 to Order No. 1601 in work time the teacher is included not only educational activities, but also methodological, organizational and diagnostic work.

A new indicator when calculating a teacher’s salary

In 2015, a new indicator was introduced into the legislation, which employers should focus on. In accordance with the Decree of the Government of the Russian Federation “On improving statistical accounting...” dated September 14, 2015 No. 973, when calculating the salaries of teachers, the employer must take into account the average monthly salary of employees working in private companies or individual entrepreneurs. The salary level cannot be lower than this indicator. Clause 3 of the Decree of the Government of the Russian Federation “On the organization of federal statistical observations...” dated July 11, 20015 No. 698 obliges Rosstat to calculate this indicator and send the information to regional authorities.

The purpose of the innovation is to increase the prestige of the teaching profession and attract new qualified personnel into the educational process.

The procedure for payments and their amount is established by federal laws, by-laws, Uniform Recommendations, as well as local acts of the educational organization. For example, the manual educational institution may issue special regulations regulating the specifics of calculation and payment of wages. The main requirement for the employer is that the nominal salary of a teacher cannot be lower than the level of 2015 (clause 4 of Russian Government Resolution No. 973). A reduction in wages is possible only if the workload on the employee is reduced.

What should a standard provision contain? about wages for education workers in 2017-2018?

Regulations on the remuneration of teachers (hereinafter referred to as the Regulations) is a document that establishes all the nuances of calculating wages in an educational organization, the amount of incentive payments, etc. It is agreed with trade union organization(if available) and approved by the head of the educational institution.

A typical provision may contain:

  • name of educational institution;
  • explanation of the main concepts of the document;
  • rules and formulas for calculating wages;
  • the procedure for changing employee salaries;
  • procedure and conditions of compensation and incentive payments;
  • responsibilities of management in organizing the calculation and payment of wages;
  • liability for late payment of wages;
  • validity period of the document;
  • pay slip form.

Also in the Regulations, the employer has the right to specify the dates of salary payment, the specifics of accrual in cases where these dates coincide with official holidays, the amount of the advance, the procedure for calculating compensation in the event of a teacher’s illness, and other aspects.

It is important to take into account the requirements of labor legislation when drawing up the document. As an example, here are a few common mistakes.

Art. 136 of the Labor Code of the Russian Federation requires employers to pay wages to employees at least 2 times a month. Establishing a single date for calculating wages is an administrative offense (Article 5.27 of the Code of Administrative Offenses of the Russian Federation). Establishing too small an advance amount in the Regulations is also unlawful, since the letter of Rostrud “Calculation of salary advances” dated 09/08/2006 No. 1577-6 establishes minimum size advance payment: it cannot be lower tariff rate employee for the time he worked.

The regulations are usually printed on paper and stored in the organization. It is approved by the signature of the head of the organization and the seal. The document is also marked with agreement with the trade union organization and the signature of its leader.

Is it necessary to draw up regulations on the remuneration of teachers?

Clause 4.1 of the order of the Ministry of Culture of the Russian Federation “On approval of the List of standard management archival documents...” dated August 25, 2010 No. 558 contains a mention of the Regulations on remuneration and bonuses for employees. However, the obligation to draw up a document is not established by law. The rules for calculating wages can be specified in the employment contract with the employee, in the internal labor regulations or in other local documents of the organization.

Thus, the management of the educational institution has the right to independently decide on the advisability of approving the Regulations. In most cases, the Regulations are present in the system of local acts of the organization, since it allows you to generalize and systematize the rules for calculating and calculating wages.

Validity period and storage procedure for the document

The legislation does not determine the validity period of the Regulation. It can be set in the document itself. If the Regulations do not provide for such a clause, it is valid until the adoption of a new local act.

The management of an educational organization has the right to adopt a new document at any time, guided by considerations economic feasibility. The organization can also make changes to the current local act. The management of the educational institution should constantly monitor innovations in legislation and change the provisions of the document in accordance with them.

The procedure for storing a document is established by Order of the Ministry of Culture No. 558. During the entire period of validity, the document must be stored in an educational institution, and after the adoption of a new regulation - in the archive for 75 years.

The regulations on the remuneration of teachers must take into account the principles established by the Unified Recommendations, as well as the new indicator for calculating salaries established by Government Order No. 973. Only in this case the document will achieve its goal - systematization of the rules for paying teachers and bringing them into compliance with current legislation.

In accordance with Federal law dated December 29, 2012 No. 273-FZ "On education in Russian Federation" and Law of the Moscow Region No. 94/2013-OZ "On Education" Government of the Moscow Region decides:

1. Approve the attached:
Regulations on remuneration of government employees educational organizations Moscow region;
Regulations on remuneration of employees of state educational organizations of higher education in the Moscow region.

2. Recommend to authorities local government municipalities Moscow region to use the Regulations approved by paragraph 1 of this resolution when preparing municipal legal acts on remuneration of municipal employees educational institutions.

3. When concluding employment contracts ( effective contracts) with managers and employees of educational organizations, it is recommended to take into account the norms provided for by this resolution.

1. General Provisions.

1. These Regulations determine the procedure and conditions for remuneration and material incentives for employees of state educational organizations subordinate to the Department of Education of the city of Moscow (hereinafter referred to as educational organizations).

2. Remuneration systems for employees of educational organizations are established by collective agreements, agreements, local regulations educational organizations in accordance with labor legislation and other regulatory legal acts containing norms labor law taking into account:

Unified tariff qualification directory jobs and professions of workers;

Unified qualification directory of positions of managers, specialists and employees, qualification directory of positions of managers, specialists and other employees;

Professional standards;

State guarantees for wages;

Opinions of the representative body of workers.

1.3. The wage fund for employees of educational organizations is formed from the amount of subsidies for financial support for the fulfillment of the state task of the educational organization, subsidies from the budget of the city of Moscow for other purposes not related to financial support their fulfillment of state assignments, as well as from funds received from income-generating activities, in terms of labor costs in accordance with the approved Plan of financial and economic activities of the educational organization.

1.4. Savings on the wage fund (including accruals on the wage fund), according to public services and material costs can be allocated by the educational organization for incentive payments.

1.5. Remuneration for part-time and part-time employees is made in proportion to the time worked.

1.6. Determination of wages for the main position, as well as for positions held part-time, is carried out separately for each position.

1.7. Conditions of remuneration for an employee of an educational organization, including the amount of salary ( official salary, wage rates), compensation and incentive payments are included in the text of the employment contract.

1.8. Salary of the employee who performed monthly norm working hours, established by law Russian Federation, and fulfilled its job responsibilities(labor standards), cannot be lower than the established minimum wage established by the Agreement on the minimum wage in the city of Moscow for the corresponding year between the Moscow Government, Moscow trade union associations and Moscow employer associations.

1.9. When developing the terms of remuneration for employees of educational organizations, it is necessary to take into account that the established wages of employees (excluding bonuses and other incentive payments) cannot be less than the wages (excluding bonuses and other incentive payments) paid to employees before its change, provided that the volume of labor (official) duties of employees and their performance of work of the same qualifications.

1.10. The share of the wage fund of administrative and managerial personnel of an educational organization is set at no more than 15.1 percent of the wage fund of the educational organization.

1.11. Share of the wage fund for educators (senior educators) implementing basic general education programs preschool education, and teachers are set at no less than 60 percent of the wage fund of the educational organization.

2. Distribution of the educational organization’s wage fund.

2.1. The wage fund of an educational organization consists of a base part (wage fund based on student-hours, official salaries, wage rates), a compensation part and an incentive part and is determined by the formula:

2.2. The incentive part of the wage fund of an educational organization is determined by the formula:

The share of incentive payments in the wage fund is at least 30 percent of the wage fund of the educational organization.

3. Formation of the basic part of the wage fund for teaching staff, determination of the cost of a “student-hour” and “child-day”.

3.1 The basic part of the wage fund for educators (senior educators) implementing basic general education programs of preschool education and teachers is determined by the formula:

3.3. The basic part of the wage fund for educators (senior educators) ( FOTv) provides guaranteed wages for educators (senior educators) based on the number of visiting days they spend and the number of students.

The cost of one “children's day” (the cost of an educational service for one estimated day of work with one estimated student) for educators (senior educators) is calculated using the following formula:

4. Basic conditions of remuneration

4.1. A teacher's salary is calculated using the formula:

a1i- the number of students per subject in each class (with the exception of students with disabilities);

a2i- the number of students in the subject in each class from among disabled children, with the exception of disabled children with musculoskeletal disorders, blind and visually impaired children;

аЗi- the number of students in the subject in each class from among disabled children with musculoskeletal disorders, blind and visually impaired children;

t i- the average number of hours per subject according to the curriculum per month in each class. The average number of hours per month is determined as the product of the weekly study load and the average number of weeks in the month (52/12).

T- bonus for checking notebooks;

TO- bonus for performing the functions of a class teacher.

4.2. The salary of a teacher (senior teacher) implementing educational programs for preschool education is calculated using the formula:

a1 i- the number of pupils in the i-th group (with the exception of pupils from among disabled children);

4.3. Remuneration for teaching staff implementing additional general development programs is carried out in accordance with the Recommendations for the development of remuneration systems for employees of state organizations for additional education of children subordinate to the Moscow Department of Education, approved by the Moscow Department of Education.

4.4. Basic conditions of remuneration for other categories of workers.

4.4.1. The amounts of salaries (official salaries, wage rates) of other categories of employees of an educational organization holding positions of specialists, managers and employees are established by the head of the organization in the context of professional qualification groups and qualification levels, not lower than the minimum recommended salaries (official salaries, wage rates), taking into account the size of the educational organization’s wage fund, as well as the complexity and volume of work performed by employees of the educational organization.

Salaries for workers' professions are established according to 8 categories of the unified tariff and qualification reference book for works and professions of workers, not lower than the Minimum Recommended Salaries depending on the category of work performed, taking into account the size of the wage fund of the educational organization.

The minimum recommended salary (official salary, wage rate) for each professional qualification group is equal to the minimum wage in the city of Moscow, approved by the Agreement on the minimum wage in the city of Moscow for the corresponding year between the Moscow Government, Moscow trade union associations and Moscow employer associations.

4.4.2. Professional qualification groups (hereinafter referred to as PQG) and the criteria for classifying blue-collar professions and office positions as PQG are approved by the federal executive body that carries out the functions of developing state policy and legal regulation in the field of labor. Normative legal acts federal bodies executive power of the Russian Federation, approving the PCG, are given in the appendix to these Recommendations.

The criteria for classifying the professions of workers and positions of employees as PKG were approved by Order of the Ministry of Health and Social Development of Russia dated August 6, 2007 No. 525 “On professional qualification groups and approval of criteria for classifying blue-collar professions and white-collar positions into professional qualification groups.”

5. Terms of remuneration for heads of educational organizations, their deputies, chief accountants

5.1. The salaries of heads of educational organizations, their deputies and chief accountants consist of official salaries, compensation and incentive payments.

5.2. The amount of official salary, incentive payments and compensation payments to the head of an educational organization are determined by an employment contract with the Moscow Department of Education in accordance with the Regulations on remuneration of heads of state educational organizations, approved by the Moscow Department of Education.

5.3. The official salary of the head of an educational organization is established by the Department of Education of the city of Moscow in direct multiple dependence on the average salary of the main staff of the educational organization. This indicator is included in Employment contract (additional agreement) with the head of the educational organization.

5.4. The official salary of the head of an educational organization is calculated annually and set for a calendar year.

5.5. The official salary of the deputy head of an educational organization and the chief accountant is set 10–30 percent lower than the official salary of the head of an educational organization.

5.6. The maximum level of average salary for deputy heads and chief accountants of an educational organization is established by the head of an educational organization by 10–30 percent below the maximum level of average salary for the head of an educational organization.

6. Establishment of compensation payments.

6.1. Compensation payments to employees of educational organizations include:

Payments to employees engaged in work with harmful and (or) dangerous and other special conditions labor;

Payments for work in conditions deviating from normal.

6.2. Compensatory payments are established by order of the head of the educational organization in accordance with labor legislation and other regulatory legal acts in the presence of appropriate working conditions.

6.3. Compensatory payments are established as a percentage of salaries (official salaries, wage rates) of employees or in absolute amounts, unless otherwise established by the legislation of the Russian Federation.

6.4. Payments of a compensatory nature are established in addition to the salaries (official salaries, wage rates) of employees, do not form a new salary (official salary, wage rate) and are not taken into account when calculating other compensation and incentive payments established in addition to the salary (official salary, wage rate) .

6.5. Payments to employees engaged in work with harmful and (or) dangerous and other special working conditions.

Subject to certification of workplaces ( special assessment working conditions) in accordance with the established procedure, compensation payments to employees engaged in heavy work or work with harmful conditions labor, are determined depending on the results of certification (special assessment) and are established in proportion to time,
worked in unfavorable conditions, in amounts determined in accordance with labor legislation and other regulatory legal acts containing labor law norms.

6.6. An educational organization applies the following compensation payments for work in conditions deviating from normal:

Payments for night work;

Payments for work on weekends and non-working holidays;

Payments for overtime work;

Payments for combining professions (positions), expanding service areas, increasing the volume of work, or performing the duties of a temporarily absent employee without releasing him from work specified in the employment contract.

6.7. The amount of compensation payments for work in conditions deviating from normal conditions is determined in accordance with labor legislation and other regulatory legal acts containing labor law norms.

7. Incentive payments.

7.1. In order to stimulate high-quality work results and reward employees for work performed, the following types of incentive payments are established in educational organizations:

Incentive payment for performance in the previous academic year;

Bonuses (based on work results in the current academic year, one-time bonuses).

Other incentive payments, with the exception of those mentioned above, cannot be established.

7.2. The application of incentive payments to salaries (official salaries and wage rates) does not form a new official salary (salary), rate and is not taken into account when calculating other incentive and compensation payments.

7.3. An incentive payment for work performance in the previous academic year is paid based on the results of the employee’s participation in achieving the following results of the educational organization:

Positive dynamics of educational results (inclusion in the list of dynamically developing educational organizations);

Education of children with special educational needs (disabled children, etc.);

Effective work to meet the needs of Moscow residents in obtaining high-quality additional educational services for a fee in excess of those financed from the budget of the city of Moscow;

For the implementation by a teaching staff of additional functions in the management of an educational organization.

7.4. Bonuses are awarded to an employee based on the results of work for the period (based on the results of the month, quarter) based on an analysis of his labor activity in accordance with bonus indicators:

7.5. An educational organization may apply one-time bonuses:

For carrying out particularly important and responsible assignments;

For the preparation and implementation of important organizational events related to the main activities of the educational organization;

For positive results of work, expressed in the special achievements of students - winners of olympiads, competitions, scientific conferences;

Other types of bonus payments.

7.6. The size of the bonus can be set both in absolute value and as a percentage of salary (official salary, wage rate) and adjusted in case of non-compliance established indicators bonuses.

In accordance with the Moscow City Law of June 20, 2001 N 25 “On the development of education in the city of Moscow”, in order to materially stimulate and encourage highly professional and proactive work of teaching and other categories of workers, the Moscow Government decides: 1.
