1. Fairs are organized by state authorities, local governments, legal entities, individual entrepreneurs (hereinafter referred to as the fair organizer). Request the Main Directorate of the Russian Ministry of Emergency Situations for Moscow to organize control over fire safety in fair venues and prompt response to possible emergency situations. 7. Request the Office of the Federal Service for Supervision of Consumer Rights Protection and Human Welfare in the city of Moscow to monitor compliance at fairs with legislation on the protection of consumer rights, including rules for the sale of certain types of goods, legislation on sanitary and epidemiological welfare of the population, quality and food safety. 8. Request to ensure the protection of public order and road safety in the venues of fairs and in adjacent areas. 9. The decree of the Moscow Government “On approval of the Procedure for organizing the activities of “weekend fairs” in the city of Moscow” shall be declared invalid. 10. Requirements for organizing weekend fairs 2.1. The prefecture of the administrative district of the city of Moscow, based on proposals from the city of Moscow, annually compiles a list of addresses for weekend fairs, taking into account the needs of residents of Moscow districts in providing certain goods and the provision of the population with retail trade enterprises in accordance with current urban planning standards. The list of addresses for weekend fairs by the prefecture of the administrative district of Moscow, at the proposal of business entities (legal entities or individual entrepreneurs), may include sites that belong to them by right of ownership or temporary possession (subject to permitted use for trade activities ). The decision on the advisability of including these sites in the list of addresses for weekend fairs is made by the Interdepartmental Commission on Consumer Market Issues under the Moscow Government in accordance with the order of the Moscow Government "On the Interdepartmental Commission on Consumer Market Issues under the Moscow Government." The list of addresses for weekend fairs is accompanied by functional zoning plans indicating the number of retail spaces. The functional zoning plan should provide for the placement of at least 90% of retail spaces for use by domestic producers of agricultural products and food products. No more than 10% of retail spaces can be used for the sale of non-food products from light industry enterprises from the regions of the Russian Federation, folk crafts and handicraft products. 2.2. The list of addresses for weekend fairs with the attached plans for the functional zoning of the territory of each fair is agreed upon with the territorial bodies of the Rospotrebnadzor Office for the city of Moscow, the Main Directorate of the Ministry of Emergency Situations of Russia for the city of Moscow and. 2.3. District lists of addresses for weekend fairs approved by the Interdepartmental Commission on Consumer Market Issues under the Moscow Government are posted on the official portal on the Internet information and telecommunications network (www.dpru.mos.ru). 2.5. The organizer of the weekend fair is the prefecture of the administrative district of Moscow. When organizing a weekend fair on a site owned or temporarily owned by an economic entity, the organizer of the weekend fair is this economic entity. 2.6. Ensuring fire safety and sanitary maintenance of the weekend fair, organizing cleaning of the weekend fair territory and removal of garbage and biological waste in accordance with the requirements established by regulatory legal acts of the Russian Federation and the city of Moscow. 2.6.7. Creating conditions for weekend fair participants to comply with personal hygiene rules (installation and maintenance of toilets, availability of water, etc.). 2.6.8. Ensuring accessibility of the territory and facilities of the weekend fair for people with disabilities and other groups of the population with limited mobility. 2.6.9. Ensuring the availability of a logbook of control activities and a first aid kit. 2.6.10. At the request of other government bodies, ensuring the provision of information necessary for monitoring and analyzing the work of weekend fairs. 2.6.11. Other functions provided for by this Procedure. 2.7. In the case where the organizer of the weekend fair is the prefecture of the administrative district of Moscow, it attracts legal entities and individual entrepreneurs to perform the services specified in paragraphs 2.6.2 - 2.6.9 on a competitive basis. 2.8. The amount of payment for the provision of equipped trading places at a weekend fair, as well as for the provision of services related to ensuring trade (cleaning up the area, garbage removal and other services), is determined by the organizer of the weekend fair, taking into account the need to compensate for the costs of organizing the fair. running day and selling goods on it. The organizer of the weekend fair publishes in the media and places on its website on the Internet information and telecommunications network information about the plan of events for organizing the weekend fair and selling goods at it. 2.10. During the entire duration of the weekend fair, a responsible person appointed by the fair organizer must be present on its territory. 2.11. At the weekend fair, an information stand is installed on which the following is posted: - information on the amount of fees for the provision of equipped trading places at the fair, as well as for the provision of services related to ensuring trade; - functional zoning plan for the weekend fair territory; - this Procedure for organizing fairs and selling goods at them; - book of reviews and suggestions; - hotline phone numbers: Office of the Federal Service for Supervision of Consumer Rights Protection and Human Welfare for the city of Moscow, Main Directorate of the Ministry of Emergency Situations of Russia for Moscow, Office of the Federal Tax Service of Russia for Moscow, prefecture of the administrative district of the city Moscow, Moscow district government for the appeal of sellers and buyers. 2.12. Trading places at a weekend fair must be equipped with information signs indicating the business entity and the region where the products are manufactured. 2.13. Check scales are installed in a place accessible to customers. 2.14. The site for the weekend fair must be landscaped. Containers for collecting garbage and biological waste, toilets and other facilities are installed on the site. 2.15. The site and the facilities located on it must be maintained in proper sanitary and technical condition during the entire duration of the weekend fair. 2.16. The site is decorated with a sign indicating the organizer of the weekend fair (name, legal address - for an organization, last name, first name, patronymic - for an individual entrepreneur), address and operating hours of the weekend fair. 2.17. On the site, in accordance with the functional zoning of the weekend fair territory, retail places are installed: trays of a single type (in the form of tension awnings on a collapsible frame), as well as specialized vehicles (car shops, auto shops, trailers), tanks for the sale of food products. The installation of other retail facilities is prohibited. 2.18. The placement of retail places, their equipping with trade and technological equipment must meet established sanitary, fire safety, environmental and other standards and rules and provide the necessary conditions for organizing trade, free passage of customers and access to places of trade. 2.19. At the end of the weekend fair (on Sunday), the retail facilities are dismantled, the site is vacated and brought into proper sanitary and technical condition. 3. Requirements for organizing specialized fairs 3.1. As part of city events and interregional agreements in the field of trade and economic cooperation, executive bodies organize specialized fairs on the basis of administrative documents of the Moscow Government. 3.2. The administrative document of the Moscow Government on the organization of a specialized fair determines the procedure for organizing a specialized fair and selling goods at it, taking into account the requirements established by the legislation of the Russian Federation on the protection of consumer rights, on ensuring the sanitary and epidemiological well-being of the population, on fire safety, on environmental protection and other requirements established by federal laws. 4. Requirements for organizing the sale of goods at fairs 4.1. Trade at fairs is carried out if sellers have: - shipping documentation for the products sold, citizens running a peasant (farm) economy, personal subsidiary plot or engaged in gardening, vegetable farming, livestock farming, - a document confirming the maintenance a citizen of a peasant (farm) holding, personal subsidiary plot or engaged in gardening, vegetable farming, livestock farming; - documents confirming the quality and safety of products; veterinary accompanying documents for products of animal origin; conclusions of the State Institution "Moscow Association of Veterinary Medicine" based on the results of veterinary and sanitary examination of products of plant and animal origin; - documents proving their identity and citizenship; - medical books of the established form with complete data of medical examinations and other documents provided for by law. The above documents are kept by sellers during the entire period of work and are presented at the first request of officials of authorized state bodies. 4.2. Goods sold at fairs must have price tags. 4.3. The sale and storage of goods at fairs is carried out in accordance with the requirements established by regulatory legal acts of the Russian Federation and the city of Moscow. 4.4. It is prohibited to use scales and metrological measuring instruments that are technically faulty, have not undergone state verification in accordance with the established procedure, as well as those not provided for by the State Register of Measuring Instruments. 4.5. Industrially produced food products must be labeled in accordance with the requirements of regulatory documents, and fruit and vegetable products of peasant and farm enterprises must be labeled with information about the place of cultivation (production) of the product. 4.6. At the weekend fair, the sale of: - imported goods is prohibited, with the exception of fruits and vegetables that do not grow on the territory of the Russian Federation; - beer, alcoholic beverages; - perfumery and cosmetic products; - tobacco products; - audio, video products, computer information media, household appliances; - products from fur raw materials and tanned sheepskin, animal skins; - animal meat, poultry and non-industrial slaughter products; - canned products, culinary products from meat and fish, confectionery products prepared at home; - meat and fish semi-finished products of non-industrial production; - unpackaged gastronomic products; - baby food; - household chemical goods; - animals; - medicines and medical products; - products made of precious metals and precious stones; - other goods, the sale of which is prohibited or limited by the legislation of the Russian Federation. 4.7. The list of goods to be sold at specialized fairs is determined by the relevant administrative document of the Moscow Government. 5. Control over the organization of fairs and the sale of goods at them Control over the organization of fairs and the sale of goods at them is carried out by authorized bodies of state control and supervision within the framework of the powers granted.

A fair for the retail sale of goods is usually called periodic, usually large retail trades, for the purpose of selling consumer goods, held in a designated place at a specified time and with the participation of many organizations and enterprises of wholesale and retail trade, industrial and agricultural enterprises - manufacturers of consumer goods , other business entities, as well as cultural and educational institutions (which provide public celebrations, games, attractions, carousel rides, etc.

During the fair, the sale of goods is primarily organized by shops and small retail trade enterprises. As a rule, the sale of goods at fairs is carried out through shopping arcades with designated retail spaces, temporary pavilions, auto shops and trailers; portable trading equipment is also actively used.

Taking into account the purpose and time of fairs, seasonal (spring-summer, autumn) and traditional fairs are distinguished; taking into account the duration of fairs, short-term fairs are distinguished and new and existing (that is, operating for a long time) fairs. Traditional fairs are held annually at a certain time (an example of a traditional fair would be the world famous Sorochinskaya Fair, which is held to coincide with the end of field work and harvesting). At seasonal fairs, a wide range of food and/or non-food products are sold, seasonal sales of goods are held at discounted prices, and on-site and off-site trade is organized.

To hold the fair, an organizing committee (coordinating committee, secretariat) is created, which includes representatives of local authorities, trading systems and individual trading enterprises, other interested enterprises and institutions. The organizing committee is responsible for the preparation and conduct of the fair, approves the conditions for participation in it, approves the plan for holding the fair and also covers expenses.

The procedure for holding fairs is determined by the organizing committee in agreement with local authorities, the procedure for holding a national fair is determined by a separate regulation, which is developed and approved by executive authorities (CMU). In the latter case, the responsibilities for the direct holding of the fair and its preparation are assigned to the legal entity determined by the organizing committee through competitive selection - the general manager of the fair.

The responsibilities of the general manager include:

Carrying out activities to prepare and conduct the fair;

Determining the end date and daily operating hours of the fair, in some cases - also the conditions for participation in it

Reviewing applications for participation in the fair and concluding agreements with fair participants;

Registration of participants and preparation of a report on the results of the fair;

Distribution of funds allocated for the preparation and holding of the fair;

Providing economic services for the fair’s activities (water, energy supply, communications, ensuring the proper sanitary and hygienic condition of the territory, ensuring fire safety, organizing the work of public catering points)

Wholesale trade enterprises, manufacturing industrial and agricultural enterprises that have the right to carry out retail trade in their own products are invited to participate in the fair. To participate in the fair, these enterprises must submit appropriate orders (which serve as the basis for their further registration), determine the form of participation in the fair (exhibition, exhibition-sale), pay the established fee, register their representatives and ensure the delivery and timely establishment of the exhibition of goods.

Holding fairs requires significant preparatory work, during which it is necessary to select a location and determine the time of the fair, arrange the territory, erect the necessary structures, determine and comprehensively design the range of goods for sale, select the composition of sales and other personnel, and carry out advertising work.

Quite often, the timing of fairs is selected taking into account the completion dates of spring or autumn agricultural work; the timing of the fair is coordinated with local authorities

As a rule, it is most convenient to use squares, stadiums, specially equipped areas, food and clothing markets and market complexes to host a fair. It is advisable to fence the fair site or mark its contours with special means. When organizing fairs, special attention must be paid to the presence of a well-developed, convenient system of transport routes. In preparation for the fair, it is also recommended to determine the order of visiting the fair for residents of nearby rural settlements.

In preparation for fairs, it is advisable to launch an advertising campaign in the press and other media, in particular, through interviews, conversations with leading specialists of manufacturing enterprises, trade organizations, scientists, from which the population can learn about the purposes of the fair, the mode and procedure for its holding, expected benefits for both participants and the public.

Seasonal fairs occupy a special place in the fair system. In the practice of domestic trade, seasonal fairs are most often held with the aim of intensifying the sale of food products such as potatoes, fruits, vegetables, and in the trade of non-food products - to intensify the sale of clothing, shoes, fabrics, goods for gardeners and other seasonal goods. Organization of seasonal fairs (seasonal trade) transfers the sale of goods of everyday and most frequent demand during 5-6 months of the spring-summer and autumn periods of the year with the organization of permanent trading zones for the sale of various groups of goods to it. Carrying out this form of selling goods creates additional conditions for quick service to the population, reducing queues during times of the most intense flows of customers, and also unloads the network of stores to intensify trade in them with other groups of goods.

One of the main elements of organizing seasonal fairs includes providing advertising and information design for both places of sale of goods (pavilions, auto shops, tents) and trading areas in these areas. The main task in this case is to attract the attention of buyers, provide them with information about the goods sold, encourage visitors to make impulse purchases and, ultimately, to increase the volume of goods and better satisfy the population's demand for consumer goods.

When determining the composition of advertising and information media for trading areas on the fair territory, it is necessary first of all to take into account the range of goods sold, the design of pavilions, tents, their location, and the nature of the fair. Moreover, in some cases, the product itself can act as a carrier of advertising information, in others - a special carrier of advertising information, which is separated from the product.

When organizing fairs, it is necessary to try to provide comprehensive information services for buyers and advertising banners, street information boards, print advertising, advertisements and advertisements in audio media (local radio and television) and print media.

Concept, types of markets, basics of their organization

Bazaars are a form of periodic retail trading in consumer goods, which are organized by trading systems and enterprises and government trade management bodies (Givli Trade and Consumer Services Administration. Regional State Administration) on the days preceding national holidays or timed to coincide with certain calendar days.

The purpose of holding bazaars is to satisfy the population’s demand for certain goods, which increases sharply at certain periods of the year, depending on the range of goods sold by trading enterprises, such as book markets, school markets (before the start of the school year), Christmas trees (on the eve of the New Year and Christmas holidays), and vegetable markets; The range of pre-holiday markets may include both food and non-food products.

For trade enterprises, the organization of markets is associated with the need to increase the number of trade and operational personnel, early accumulation of inventory, and the development of measures to better serve customers.

Places for organizing bazaars, as a rule, are allocated by decision of local authorities in specially designated areas. The bazaar can be held both in open areas and indoors. In this case, the market can be organized either in one room or in several pavilions and tents located close to each other.

Large trading enterprises (department stores, supermarkets, specialty stores) often organize bazaars on the territory adjacent to the store, thereby eliminating the need to organize transport and delivery operations for goods to trading places. To hold bazaars near a stationary retail network, free areas and premises of sports and exhibition complexes, stadiums, train stations and other non-trade premises are used.

As during fairs, the sale of goods during bazaars is carried out through shopping arcades. At the same time, at the workplace of each seller there must be a sign indicating the name, location and telephone number of the business entity that organized the away (remote) trade, as well as the last name, first name and patronymic of the seller. At the workplace of a citizen entrepreneur there must be a sign indicating his address, the number of the certificate of state registration of the business entity and the name of the body that carried out this registration.

Since the sale of goods during bazaars is carried out, as a rule, through points and facilities (pavilions for seasonal trade, trade tents, auto shops, trailers, delivery stations, etc.) that belonged to small retail trade network enterprises, the main regulatory document regulating the procedure sales of goods and the work of market participants in general are. I. General provisions

1. The procedure for organizing fairs and selling goods (performing work, providing services) at them on the territory of the city of Moscow (hereinafter referred to as the Procedure) was developed in accordance with Article 11 of the Federal Law of December 28, 2009 N 381-FZ “On the Fundamentals of State Regulation of Trade activities in the Russian Federation" and establishes the rules for organizing fairs on the territory of the city of Moscow by executive authorities of the city of Moscow and other constituent entities of the Russian Federation, executive authorities of other member states of the Eurasian Economic Union, the State budgetary institution of the city of Moscow "Moscow Fairs" on land plots located in state ownership of the city of Moscow or state ownership for which is not demarcated, as well as requirements for organizing the sale of goods (including goods to be sold at fairs of the relevant types and included in the corresponding list) and the performance of work and provision of services at fairs.

This Procedure applies to fairs organized by legal entities (including industry associations), individual entrepreneurs on land plots owned by them by right of ownership or other right, subject to the use of these land plots in accordance with the intended purpose and type of permitted use.

This procedure applies to fairs organized by local governments of urban districts and settlements in the city of Moscow on land plots that are municipally owned, in terms of compliance with the requirements of sections II “Requirements for fair sites”, VII “Requirements for places for selling goods (performing work) , provision of services) at fairs", VIII "Requirements for organizing the sale of goods (performance of work, provision of services) at fairs" and paragraph 51 of this Procedure.

The procedure for providing places for the sale of goods (performance of work, provision of services) at fairs organized by local government bodies of urban districts and settlements in the city of Moscow is established by the specified local government bodies.

The fair's work schedule is set by the fair's organizers.

2. Basic terms and concepts used in this Procedure:

- fair - a trade event limited in time, usually periodically repeated, held in a designated place, at which many sellers (fair participants) offer buyers goods (works or services) in accordance with the type of fair;

- fair site - the territory of real estate designated for the fair;

- a place for selling goods (performing work, providing services), a specially equipped place at the fair site for carrying out activities for selling goods (performing work, providing services);

- organizer of the fair - executive authority of the city of Moscow, State budgetary institution of the city of Moscow "Moscow Fairs", executive authority of another constituent entity of the Russian Federation or another state - a member of the Eurasian Economic Union, legal entity, individual entrepreneur organizing and holding a fair at the fair site ;

- fair participant - a legal entity, an individual entrepreneur, as well as a citizen (including a citizen - the head of a peasant (farm) enterprise, a citizen running a personal subsidiary plot or engaged in gardening, horticulture, livestock farming), who has the right to be accommodated at the fair site, registered according to established order;

Trading session - all trading periods for a period determined by the Department of Trade and Services of the city of Moscow when announcing the application campaign and amounting to at least two and no more than three upcoming calendar months;

- trading period - 3 (three) days (Friday, Saturday, Sunday);

- waiting list - an electronic register of applicants whose applications were accepted for consideration on the Portal of state and municipal services (functions) of the city of Moscow (hereinafter referred to as the Portal), but who, following the results of the first application campaign, were not provided with places for the sale of goods (performance of work, provision of services ) at weekend fairs. Applicants are included in this register by product groups in the order of the numbers assigned to their applications during registration.

3. Fairs are divided into types:

- weekend fair - a fair regularly organized and held on Friday, Saturday, Sunday, on land plots that are state owned by the city of Moscow, or state ownership for which is not demarcated;

specialized fair - a fair, periodically or one-time organized and held in accordance with the legal acts of the Department of Trade and Services of the city of Moscow, at which at least 80% of the places are intended for the sale of goods of the same class in accordance with the All-Russian Classification of Products, or goods related to a single theme, or timed to coincide with cultural and other events, as well as holidays and city events;

regional fair - a periodically or one-time organized and held fair for the sale of goods of declared regions and industry associations in order to implement intergovernmental and interregional agreements in the field of trade and economic cooperation, as well as support for Russian manufacturers of goods;

- interregional fair - a periodically or one-time organized and held fair for the sale of agricultural products and food products of the regions of the Russian Federation, industry associations and member states of the Eurasian Economic Union, the participants of which are sellers from several regions, as well as member states of the Eurasian Economic Union.

4. The organizers of the fairs are:

- weekend fairs and interregional fairs - State Budgetary Institution of the City of Moscow "Moscow Fairs";
Decree of the Moscow Government dated January 20, 2016 N 6-PP; Decree of the Moscow Government dated August 23, 2017 N 583-PP.

- specialized fairs - executive authorities of the city of Moscow, legal entities, individual entrepreneurs, determined in accordance with the legal acts of the Department of Trade and Services of the city of Moscow on the organization and holding of such fairs;

- regional fairs - executive authorities of the constituent entities of the Russian Federation, executive authorities of other member states of the Eurasian Economic Union, as well as legal entities determined by them, including industry associations.

5. Veterinary safety checks of all food raw materials and food products of animal origin and non-industrial crop products sold at fairs are carried out in laboratories, including state laboratories for veterinary and sanitary examination, mobile laboratories and departments of state veterinary examination of the State Budgetary Institution of the City of Moscow "Moscow Association of Veterinary Medicine".

Payment for veterinary services provided is collected from sellers (owners) of the specified products in accordance with the price list for paid veterinary services of the State Budgetary Institution "Moscow Association of Veterinary Medicine".

II. Requirements for fair sites

6. At each fair there must be an information stand on which the following are placed:

1) information on the amount of fees for the provision of equipped places for the sale of goods (performance of work, provision of services) at the fair, as well as for the provision of services related to ensuring trade (if a fee is established);

2) a functional zoning plan for the fair site (hereinafter referred to as the functional zoning plan);

3) telephone numbers of the Office of the Federal Service for Supervision of Consumer Rights Protection and Human Welfare in Moscow, the Main Directorate of the Ministry of Emergency Situations of Russia in Moscow, the Main Directorate of the Ministry of Internal Affairs of Russia in Moscow, the Office of the Federal Tax Service in Moscow, the Department of Trade and services of the city of Moscow, the Veterinary Committee of the city of Moscow, the prefecture of the administrative district of the city of Moscow and the government of the district of the city of Moscow, on the territory of which the fair is held, information about the organizer of the fair.

7. The fair site is decorated with a sign indicating the organizer of the fair (name, location - for an organization, last name, first name, patronymic - for an individual entrepreneur), address and operating hours of the fair, as well as the name of the fair.

8. The fair site must be landscaped and have a hard surface or flooring that prevents damage to the soil layer. At the fair site, storage modules are installed for storing trade equipment, containers for collecting garbage and biological waste, dry closets (if necessary) and other objects necessary for the functioning of the fair.

9. At fair sites, when organizing places for selling goods (performing work, providing services), it is prohibited to use bricks, building blocks and slabs, to bury structures, equipment and fencing, to lay underground utilities and to carry out capital construction and installation work.

10. Organization of weekend fairs on the roadway of the Moscow road network is possible in agreement with the Department of Transport and Development of Road Transport Infrastructure of the City of Moscow and the State Traffic Safety Inspectorate of the Ministry of Internal Affairs of Russia for Moscow.

11. To organize fair sites, only land plots (territories) are used that provide convenient access for vehicles that do not interfere with the passage of pedestrians.

12. The sites of regional fairs are not allowed to be used for organizing weekend fairs. Free sites at regional fairs can be used to hold interregional and specialized fairs in the prescribed manner.

13. At the sites of regional and specialized fairs, places are organized for the sale of goods (performance of work, provision of services) (trays, carts, auto stalls), including the use of traditional national, folklore and other design elements.

14. On the day the fair ends, trading facilities are dismantled or removed, the fair site is vacated and brought into proper sanitary and technical condition.

III. The procedure for compiling a list of weekend fair sites and a list of regional fair sites

15. To organize weekend fairs and regional fairs, the prefecture of the administrative district of the city of Moscow, based on proposals from business entities, district governments of the city of Moscow and councils of deputies of municipal districts, annually, before August 1, creates a draft list of weekend fairs for the next calendar year, taking into account the needs residents of Moscow districts in providing certain goods and, before September 1, forms a draft list of regional fairs for the next calendar year.

16. The draft list of fairs includes information about the address of the fair site, its area and the number of trading places. The draft list of fairs is accompanied by plans for the functional zoning of the sites of each fair, indicating the location of places for the sale of goods (performance of work, provision of services) and their quantity (only for weekend fairs), as well as the location of warehouse modules.

17. The prefecture of the administrative district of Moscow sends the prepared draft list of weekend fairs with attached functional zoning plans for fair sites no later than August 5, a draft list of regional fairs no later than September 5, for approval to the territorial bodies of the Rospotrebnadzor Office for Moscow. , Main Directorate of the Ministry of Internal Affairs of Russia for Moscow, Main Directorate of the Ministry of Emergency Situations of Russia for Moscow.

After receiving the approvals provided for in this paragraph, the draft list of weekend fairs (in part of the territory of the municipal district) with the attached plans for the functional zoning of fair sites is submitted for approval to the council of deputies of the municipal district no later than September 1.

The council of deputies of the municipal district considers the draft list of weekend fairs within 21 calendar days from the date of its receipt by the council of deputies of the municipal district.

The draft list of weekend fairs is considered approved if more than half of the established number of the council of deputies of the municipal district voted for the decision to approve it as a result of an open vote, and also if, within 21 calendar days from the date of its receipt by the council of deputies of the municipal district:

- not a single meeting of the council of deputies of the municipal district was held;

- the issue of approval is not included in the agenda of the meeting of the council of deputies of the municipal district;

- the issue of approval was included in the agenda of the meeting of the council of deputies of the municipal district, but was not considered at the meeting of the council of deputies of the municipal district.

The council of deputies of a municipal district may approve the draft list of weekend fairs in full, partially approve the draft list of weekend fairs, or decide to refuse approval of the project.

If a decision is made to refuse approval of the draft list of weekend fairs, the specified draft, after its revision, may be re-sent for approval to the council of deputies of the municipal district.

The decision of the council of deputies of the municipal district on approval, partial approval or refusal to approve the draft list of weekend fairs is sent to the prefecture of the administrative district of the city of Moscow no later than three working days from the date of its adoption.

18. After receiving all approvals, the prefecture of the administrative district of Moscow sends to the Interdepartmental Commission on Consumer Market Issues under the Moscow Government:

- no later than October 1, a draft list of regional fairs;

- no later than October 20, a draft list of weekend fairs (to the extent agreed upon by the councils of deputies of municipal districts).

19. If there are unaccounted comments from approving organizations and unaccounted for proposals from business entities and district governments of the city of Moscow, a sheet of disagreement with justification for the decision made is attached to the draft lists of fairs.

20. The Interdepartmental Commission on Consumer Market Issues under the Moscow Government reviews draft lists of fairs within 30 working days and makes a decision on approval of the project or the need for its modification.

21. The draft lists of fairs approved by the Interdepartmental Commission on Consumer Market Issues under the Moscow Government after signing the minutes of the Commission meeting are approved within no later than 3 working days:

21.1. For weekend fairs - by orders of the prefecture of the administrative district of the city of Moscow and are subject to publication on the official websites of the Department of Trade and Services of the city of Moscow and the prefecture of the administrative district of the city of Moscow on the information and telecommunications network Internet.

21.2. For regional fairs - by order of the Department of Trade and Services of the City of Moscow and is subject to publication on the official websites of the Department of Trade and Services of the City of Moscow (in full) and the websites of the prefectures of the administrative districts of the city of Moscow (list of fair sites located on the territory of the corresponding administrative district of the city of Moscow) in information and telecommunications network Internet.

21(1). Approved lists of fairs must contain information about the area of ​​the site of each fair.

22. Amendments to the list of fair sites are carried out according to the rules provided for in paragraphs 15-21 of this Procedure. In case of exclusion of a site or replacement of the address of a weekend fair from the approved address list, participants who were provided with a trading place at this fair during the current trading session are sent a decision to withdraw the provided trading place or replace the address of the fair unilaterally 14 calendar days before the moment the site closes.

IV. Procedure for organizing a weekend fair

23. The organizer of a weekend fair, within 10 calendar days after the adoption of the order on approval of the list of sites for weekend fairs, develops an action plan for organizing a weekend fair and selling goods (performing work, providing services) at it in accordance with the Standard for holding weekend fairs on territory of the city of Moscow, and also determines the operating hours of the fair and the procedure for its organization.

The standard for holding weekend fairs on the territory of the city of Moscow is approved by a legal act of the Department of Trade and Services of the city of Moscow and provides requirements for:

- arrangement of the fair site;

- organizing the placement of containers for solid waste and biological waste at the fair site and ensuring their removal;

- providing fair participants with personal hygiene;

- ensuring the fair’s power supply and fire and sanitary rules for the fair’s operation;

- placement of places and equipment for selling goods at the fair site;

- clearing the fair site and storing trade equipment and inventory;

- ensuring security measures at the fair site.

The plan of events for organizing a weekend fair and selling goods at it, the procedure for organizing the fair and its operating hours are subject to publication by the fair organizer on the official website of the fair organizer on the Internet.

24. The opening hours of the weekend fair (working hours) are determined by the organizer, taking into account the elimination of the negative impact of the fair on the pedestrian and transport infrastructure.

The periods for holding weekend fairs in a calendar year are determined by the organizer of these fairs.

25. The procedure for providing places for selling goods (performing work, providing services) at a weekend fair:

25.1. Places for the sale of goods (performance of work, provision of services) at a weekend fair are provided only in electronic form using the Portal of state and municipal services (functions) of the city of Moscow (hereinafter referred to as the Portal) based on a request from a person who intends to take part in the fair (hereinafter referred to as - applicant) in accordance with this procedure and the Administrative Regulations for the provision of public services "Providing a place for the sale of goods (performance of work, provision of services) at a weekend fair in Moscow or refusal of the provided place for the sale of goods (performance of work, provision of services) at specified fair", with the exception of the place for the sale of goods (performance of work, provision of services) at weekend fairs, provided in the manner provided for in paragraphs six and seven of clause 25.4 of this Procedure.

25.2. No fee is charged from weekend fair participants for the provision of places to sell goods (perform work, provide services), with the exception of fees for services provided for in paragraph 5 of this Procedure.

25.3. Requests for the provision of a place to sell goods (perform work, provide services) at weekend fairs (hereinafter referred to as the request) are accepted during the application campaign.

25.4. The request can be submitted by the applicant in relation to one administrative district of the city of Moscow, on the territory of which several weekend fairs can be selected. In this case, an applicant from among the citizens - heads of peasant (farm) households, citizens running personal subsidiary plots or engaged in gardening, vegetable farming, livestock farming, can submit a request only for the group of goods “vegetables and fruits”. At each weekend fair, the applicant is provided with one place to sell goods (perform work, provide services). To participate in weekend fairs located in other administrative districts of Moscow, the applicant submits additional requests.

If these requests are submitted by legal entities and individual entrepreneurs, they indicate information about sellers who will trade at weekend fairs on behalf of the relevant legal entities and individual entrepreneurs.

Legal entities and individual entrepreneurs in the request have the opportunity to indicate information about only three sellers within one platform.

If it is necessary to change information about the seller, the applicant, 10-15 days before the start of the trading period, makes appropriate changes to the application in the applicant’s “personal account” subsystem on the Portal, in which he indicates the new data of the seller.

Sixty percent of the total number of trading places for the group of goods "vegetables and fruits" are provided to citizens who have personal subsidiary plots or are engaged in gardening, horticulture, livestock farming, twenty percent are provided to citizens - heads of peasant (farm) households, the remaining twenty percent of trading places for the group of goods "vegetables and fruits" are distributed between legal entities and individual entrepreneurs.

The procedure for providing a place for the sale of goods (performance of work, provision of services) by pensioners and (or) disabled people at a weekend fair is determined by the organizer of the fair and, within 5 days from the date of its adoption, is subject to publication on the official website of the State Budgetary Institution of the City of Moscow "Moscow Fairs" in information and telecommunications network Internet.

Citizens - heads of peasant (farm) households, citizens running personal subsidiary plots or engaged in gardening, horticulture, livestock farming, have the right to indicate in the request their close relatives, determined in accordance with the Family Code of the Russian Federation, as sellers.

25.5. The application campaign is carried out by the fair organizer for the relevant trading sessions and trading periods.

The first application campaign opens 20 calendar days before the start of the trading session and lasts 5 calendar days.

The second application campaign opens in the event of availability of places for the sale of goods (performance of work, provision of services) (subject to cancellation of the waiting list), weekly for three calendar days, no later than 8 calendar days before the start of the next trading period.

Requests during the first application campaign are submitted only for the next trading session or for individual trading periods in a given trading session.

Requests during the second application campaign are submitted only for the remaining trading periods in the current trading session.

Based on the results of application campaigns, a register of decisions is formed on the provision or withdrawal of places for the sale of goods (performance of work, provision of services) at a weekend fair (hereinafter referred to as the Register of Decisions), which is published on the website of the organizer of the weekend fair and placed on the information stand of the weekend fair in accessible place for viewing.

The procedure for revoking places for selling goods (performing work, providing services) at a weekend fair is established by clause 25.10 of this Procedure.

25.6. The organizer of the weekend fair publishes the following information on the website of the Moscow Department of Trade and Services:

- information on the number of places for selling goods (performing work, providing services) at the fair by groups of goods depending on the season of their sale - no later than 10 working days before the start of the first application campaign;

- information on the availability of available places for the sale of goods (performance of work, provision of services) based on the results of the first application campaign - no later than 6 working days after its end;

- information on the availability of available places for the sale of goods (performance of work, provision of services) based on the results of the second application campaign - no later than 5 working days after its end;

- information about vacant trading places for the sale of goods (performance of work, provision of services) based on the results of the revocation of decisions on the provision of places for the sale of goods (performance of work, provision of services) at a weekend fair - no later than 9 working days before the start of the corresponding trading period .

25.7. The provision of places for selling goods (performing work, providing services) at weekend fairs is carried out by groups of goods depending on the season of their sale and the actual availability of retail places, taking into account the following requirements:

First of all, the first application of each applicant within the framework of the application campaign is satisfied;

Satisfaction of the second and subsequent applications of each applicant is carried out in accordance with the order of their registration within the framework of the application campaign;

The total number of places at fairs in all administrative districts of Moscow provided to one applicant cannot exceed the number of unique sellers indicated in their applications.

The procedure for determining the number of places for selling goods (performing work, providing services) by groups of goods depending on the season of their sale is approved by the Department of Trade and Services of the city of Moscow.

Based on the results of consideration of his application, the applicant is given an extract from the Register of Decisions (sent to the applicant’s “personal account” on the Portal or, at the applicant’s request, issued in writing in the prescribed manner), which is the basis for placing a fair participant on the fair site or a decision to refuse to provide places for the sale of goods (performance of work, provision of services) on the grounds provided for by the Administrative Regulations for the provision of public services "Providing a place for the sale of goods (performance of work, provision of services) at a weekend fair in Moscow or refusal of the provided place for the sale of goods (performance works, provision of services) at the specified fair."

Applicants whose application was accepted for consideration on the Portal, but who, following the results of the first application campaign, were not provided with a place to sell goods (perform work, provide services) at a weekend fair in accordance with this Procedure, are automatically included in the waiting list for groups of goods in in the order of priority of the numbers assigned to their applications during registration.

During the current trading session, if there are free places for selling goods (performing work, providing services) at weekend fairs, such places are provided to applicants on the waiting list, including at other sites.

25.8. The organizer of the weekend fair provides accommodation for fair participants in accordance with the issued extracts from the Register of Decisions.

25.9. The organizer of the weekend fair, in accordance with the extract from the Register of Decisions, checks the organization and conduct of the fair, including:

- the actual presence of the fair participant on site to sell goods (perform work, provide services) during the trading period specified in the extract from the Register of Decisions;

- the fact that the fair participant has the documents specified in paragraph 41 of this Procedure;

- compliance by the fair participant with assortment specialization for the group of goods specified in the extract from the Register of Decisions;

- compliance of the fair participant with the information contained in the Extract from the Register of Decisions;

- compliance by the fair participant with the requirements established by Section VII of this Procedure;

25.10. If facts of violation by fair participants of the conditions for organizing and holding the fair specified in clause 25.9 of this Procedure are revealed, the fair organizer draws up a report on the identified violations with attached materials photographing the violations, reflecting the number of the trading place and the identified violations themselves on the day the said violations were discovered.

The report is drawn up based on the results of each trading period and includes the results of monitoring for two days - Friday, Saturday or Sunday.

The act of identified violations, after its signing, is entered into the Unified City Automated System of Information Support and Analytics of the Consumer Market (EGAS SIOPR) by the responsible executives of the fair organizer the next day after the end of the corresponding trading period.

The portal automatically generates a decision to revoke the place provided to the fair participant for the sale of goods (performance of work, provision of services) in the presence of one report on identified violations in the following cases:

- the actual absence of the fair participant on site to sell goods (perform work, provide services) on the days of monitoring the first trading period of the current trading session, while the first trading period is determined by the date of the actual provision of the place to the fair participant;

- an act drawn up in relation to the fair participant on violations identified by the territorial body of the Office of Rospotrebnadzor for the city of Moscow, the Moscow Veterinary Committee and other regulatory authorities, or a notification of violations identified by the State Budgetary Institution of the city of Moscow "Moscow Association of Veterinary Medicine" within the limits of the powers granted;

- non-compliance by the fair participant with the assortment specialization specified in the extract from the Register of Decisions on the days of monitoring the first trading period of the current trading session;

Inconsistency of information about the fair participant with the information contained in the extract from the Register of Decisions on the days of monitoring the first trading period of the current trading session.

The portal automatically forms a decision to revoke the place provided to the fair participant for the sale of goods (performance of work, provision of services) in the presence of two reports of violations identified on monitoring days for two consecutive trading periods, in the following cases:

- non-compliance by the fair participant with assortment specialization due to non-compliance with the group of goods specified in the extract from the Register of Decisions;

- discrepancy between the information about the fair participant and the information contained in the Extract from the Register of Decisions;

- the actual absence of the fair participant on site for the sale of goods (performance of work, provision of services) in the second and subsequent trading periods of the current trading session, when the fair participant did not refuse the provided place for the sale of goods (performance of work, provision of services) at the weekend fair in in the manner provided for in paragraph 25.10(1) of this Procedure;

- failure of the fair participant to comply with the requirements established by Section VII of this Procedure;

Failure of the fair participant to comply with the requirements established by paragraph 44(1) of this Procedure.

If facts about a fair participant are identified that do not correspond to the information contained in the extract from the Register of Decisions, and after drawing up an act on the identified violations, the fair organizer ensures the suspension of the trade activities of the fair participant at the relevant trading place for the sale of goods (performance of work, provision of services) until the identified violations are eliminated violations.

The decision to revoke a place for selling goods (performing work, providing services) from a fair participant is drawn up in two copies, one of which is sent to the fair participant in the applicant’s “personal account” on the Portal no later than one working day from the date of signing.

If a place for selling goods (performing work, providing services) is revoked from a fair participant on the grounds established by this section, this participant is not provided with another place for selling goods (performing work, providing services) within the administrative district of the city within the current trading session Moscow, in which such a place was withdrawn, within a year.

The application of such participants is not accepted for consideration on the Portal automatically if there are submitted Reports of identified violations, issued in accordance with the established procedure in relation to such participants.

In case of withdrawal of a place for the sale of goods (performance of work, provision of services), the fair participant has the right to submit an application for provision of a place for the sale of goods (performance of work, provision of services) in the manner established by the Administrative Regulations for the provision of public services "Provision of a place for the sale of goods (performance of work , provision of services) at a weekend fair in the city of Moscow or refusal of the provided place for the sale of goods (performance of work, provision of services) at the specified fair", at the site of a weekend fair in another administrative district of the city of Moscow.

25.10(1). A fair participant has the right to refuse the place provided to him for selling goods (performing work, providing services) at a weekend fair no later than 7 calendar days before the start of the upcoming trading period and no more than two trading periods during the current trading session or from all places provided to him for the sale of goods (performance of work, provision of services) at a weekend fair for all trading periods during the current trading session.

A request to refuse a place provided for the sale of goods (performance of work, provision of services) at a weekend fair by a fair participant is submitted only in electronic form using the Portal in the manner prescribed by the Administrative Regulations for the provision of public services "Provision of a place for the sale of goods (performance of work, provision services) at a weekend fair in the city of Moscow or refusal of the provided place for the sale of goods (performance of work, provision of services) at the specified fair."

Submitting a request to refuse the allocated place for selling goods (performing work, providing services) at a weekend fair less than 7 calendar days before the start of the upcoming trading period is not allowed.

A fair participant who has submitted a request to refuse the provided space for selling goods (performing work, providing services) at a weekend fair is notified within one working day:

On acceptance of refusal of a place for selling goods (performing work, providing services) at a weekend fair for a selected trading period or for two selected trading periods during the current trading session - in case of refusal of one or two trading periods during the current trading session;

On the early termination of the decision to provide a place for the sale of goods (performance of work, provision of services) at a weekend fair during the current trading session - in case of refusal of the provided place at the weekend fair for all trading periods during the current trading session.

25.11. In case of revocation of a place or refusal of a place provided for the sale of goods (performance of work, provision of services), the fair organizer, no later than the next working day after the end of the relevant trading period, sends (electronically through the Portal) to all applicants on the waiting list for the relevant specialization, proposal to participate in a competition to fill the vacant place at the weekend fair for subsequent trading periods within the current trading session.

Applicants who have sent their consent to take the provided place for the sale of goods (perform work, provide services), but such a place has not been provided to them in accordance with this Procedure, remain on the waiting list until such a place is provided to them or ends current trading session.

If the applicant does not send a response electronically through the Portal within the day following the day the proposal for the provision of a vacated trading space was sent, the proposal in respect of this applicant is considered canceled and the corresponding applicant is removed from the waiting list.

After all applicants are removed from the waiting list or after the end of the current trading session, the waiting list is canceled automatically.

25.12. If there are available places at other weekend fair sites, all applicants on the waiting list for the relevant specializations are sent offers to fill the available places for subsequent trading periods within the current trading session.

After receiving this proposal, the applicant, within one working day, sends a response on consent or refusal of the provided place for the sale of goods (performance of work, provision of services) electronically through the Portal.

A place at the weekend fair for subsequent trading periods within the current trading session is provided with the consent of the applicant to take the provided place for the sale of goods (performance of work, provision of services) in the order of the numbers assigned to the applicants' applications during registration.

An applicant who has been approved for a retail space will be removed from the waiting list.

Applicants who have sent their consent to take the provided place for the sale of goods (perform work, provide services), but such a place has not been provided to them in accordance with this Procedure, remain on the waiting list until such a place is provided to them or ends the current trading session, within its sequence.

If the applicant does not send a response electronically through the Portal within the day following the day of sending the offer to provide a vacant trading space, he remains on the waiting list until such a space is provided or the current trading session ends.

V. Procedure for organizing a regional fair

26. To hold a regional fair, the head of a constituent entity of the Russian Federation, his deputy, the head of an executive authority of a constituent entity of the Russian Federation performing functions in the field of trade, agro-industrial complex or agriculture, an executive authority of another member state of the Eurasian Economic Union no earlier than 120 calendar days days and no later than 30 calendar days before the expected date of the regional fair, submits to the Moscow Department of Trade and Services the original application for holding a regional fair, which indicates:

- name, address of the organizer of the regional fair;

- period of the regional fair (start and end dates of the regional fair);

- specialization of the regional fair (if any);

- number of participants at the regional fair;

- obligations of the fair organizer to organize fire safety and sanitary maintenance of the regional fair, cleaning and maintaining cleanliness at the regional fair site, removing garbage and biological waste, ensuring the safety of the property of participants in the regional fair, including, if necessary, organizing security measures for the period of the regional fair;

- last name, first name, patronymic (if any) of the person authorized to represent the interests of the organizer of the regional fair, the scope of powers of such a person, including the powers to coordinate the timing of the regional fair and (or) fair site, contact phone number, postal address and (or) email address through which such person can be contacted.

27. An application for holding a regional fair is signed by the head of a constituent entity of the Russian Federation, his deputy, the head of the executive authority of a constituent entity of the Russian Federation in the field of trade, agro-industrial complex, agriculture, or an executive authority of another state - a member of the Eurasian Economic Union - organizer of the regional fair.

If an application is submitted directly (in person) to the Department of Trade and Services of the City of Moscow, an identification document of the person submitting the application, as well as a duly certified copy of the document confirming the authority of such person to submit the application on behalf of the relevant executive authority, is submitted with the application.

28. The clause has lost force since July 19, 2016 - Moscow Government Resolution No. 400-PP dated July 7, 2016..

29. The fact of submitting an application is confirmed by the stamp of the Department of Trade and Services of the city of Moscow indicating the date and time of receipt of the application.

A stamp is affixed to the application and its copy, which, at the request of the person submitting the application, is given to such person or sent to the organizer of the regional fair.

The procedure for considering an application for holding a regional fair and providing a site for a regional fair is approved by a legal act of the Department of Trade and Services of the city of Moscow.

30. The Department of Trade and Services of the city of Moscow, when organizing and holding regional fairs, coordinates the activities of the executive authorities of the city of Moscow and the organizers of the fairs.

30(1). The regional fair is organized and held in accordance with the Standard for holding a regional fair on the territory of the city of Moscow.

The standard for holding a regional fair on the territory of the city of Moscow is approved by a legal act of the Department of Trade and Services of the city of Moscow and provides requirements for:

30(1).1. Arrangement of the regional fair site.

30(1).2. Equipping places for selling goods (performing work, providing services) at the regional fair site.

30(1).3. Information support for the regional fair.

30(1).4. Preparation and submission of reports on the results of the regional fair.

31. The organizer of the regional fair, together with the prefecture of the administrative district of the city of Moscow, approves an action plan for organizing the regional fair and the sale of goods (performance of work, provision of services) at it and sends it to the Department of Trade and Services of the city of Moscow for approval, which defines:

1) powers of the prefecture of the administrative district of the city of Moscow in terms of:

- provision of a landscaped (asphalted) site;

- publications in the media and placement of information about the regional fair on its website in the information and telecommunications network Internet.

2) the timing of each event to organize a regional fair;

3) functions of the organizer of a regional fair;

4) the person(s) responsible for holding the regional fair, who must be on the site of the regional fair during the entire period of its operation;

5) operating hours of the regional fair.

6) the powers of the Department of Trade and Services of the city of Moscow in terms of ensuring the equipment of places for the sale of goods (performance of work, provision of services) at regional fairs (installation, dismantling, security of fair structures).

32. The organizers carry out the following activities to organize the regional fair:

- determining the procedure for providing places for selling goods (performing work, providing services) at a regional fair (including providing fair participants with trade and technological equipment, its installation before the start of trade and dismantling after it ends);

- if necessary, determining the amount of payment for the provision of equipped places for the sale of goods (performance of work, provision of services) at a regional fair, as well as for the provision of services related to ensuring trade (cleaning the territory and other services);

- organizing fire safety and sanitary maintenance of the regional fair site, cleaning the regional fair site, removing garbage and biological waste during the regional fair, ensuring compliance by regional fair participants with the requirements of veterinary legislation;

- other events in accordance with the approved action plan for organizing a regional fair and selling goods (performing work, providing services) at it.

V(1). The procedure for organizing an interregional fair

32(1). Interregional fairs are located on the basis of the layout of interregional fairs (hereinafter referred to as the layout), approved by the Department of Trade and Services of the city of Moscow.

32(2). The layout should contain: address guidelines, specialization, size of sites for interregional fairs.

32(3). In order to host the interregional fair, the Department of Trade and Services of the City of Moscow sends the following materials to the Committee on Architecture and Urban Planning of the City of Moscow to prepare a conclusion on the presence of urban planning restrictions, including on utility networks (hereinafter referred to as the conclusion):

Accommodation project;

Project of architectural and artistic solution for an interregional fair with a 3D model;

Photomontage (graphic drawing of the boundaries of the interregional fair with indication of linear dimensions on a scale of 1:50).

If the fair is located within the boundaries of the territories of cultural heritage objects, identified objects of cultural heritage, as well as on a land plot directly connected to the land plot within the boundaries of the territories of cultural heritage objects, identified objects of cultural heritage, the placement project must contain a section on ensuring the safety of the cultural heritage object , identified cultural heritage site.

32(4). The Committee on Architecture and Urban Planning of the City of Moscow, no later than 20 working days from the date of receipt of the materials specified in paragraph 32(3) of this Procedure, prepares a conclusion.

32(5). The conclusion includes a situational plan of the site, made on a scale of 1:2000, a master plan of the site, made on a geo-based basis, indicating the location of the interregional fair on a scale of 1:500, photographic materials, photomontage (3D visualization).

32(6). The conclusion is an integral part of the placement project.

32(7). The Department of Trade and Services of the City of Moscow, no later than three working days from the date of receipt of the conclusion from the Committee on Architecture and Urban Planning of the City of Moscow, sends the placement project with the attached conclusion for approval to:

32(7).1. Department of City Property of the City of Moscow.

32(7).2. Department of Cultural Heritage of the City of Moscow (if an interregional fair is located within the boundaries of territories and protection zones of cultural heritage sites).

32(7).3. Department of Transport and Development of Road Transport Infrastructure of the City of Moscow (in the case of hosting an interregional fair on elements of the road network).

32(7).4. Department of Natural Resources Management and Environmental Protection of the City of Moscow (if an interregional fair is located within the boundaries of specially protected natural areas, natural and green areas of the city of Moscow, under the jurisdiction of the department).

32(8). The period for approval of the placement project by the executive authorities of the city of Moscow specified in paragraph 32(7) of this Procedure is no more than 10 working days from the date of its receipt.

If the specified bodies fail to provide information on approval or submit an unmotivated refusal to approve within the established time frame, the placement project is considered approved by default.

When submitting a reasoned refusal to approve the placement project, the specified project, after its revision, is re-sent for approval to the executive authority of the city of Moscow that submitted this refusal. The approval period for a revised placement project is no more than 7 working days from the date of its receipt.

32(9). The placement scheme is approved by the Department of Trade and Services of the city of Moscow within 5 working days from the date of the last approval of the placement project by the executive bodies of the city of Moscow specified in paragraph 32(7) of this Procedure.

32(10). To participate in the interregional fair, executive authorities of the Russian Federation and member states of the Eurasian Economic Union that intend to participate in the interregional fair submit applications to the State Budgetary Institution of the City of Moscow "Moscow Fairs".

An application for participation in the interregional fair is signed by the head of a constituent entity of the Russian Federation, his deputy, the head of an executive authority of a constituent entity of the Russian Federation in the field of trade, agro-industrial complex, agriculture, or an executive authority of another state - a member of the Eurasian Economic Union.

32(11). Participants of the interregional fair are not charged for the provision of places for the sale of goods (performance of work, provision of services), with the exception of fees for the services provided for in paragraph 5 of this Procedure, as well as for the consumption of electrical energy, heating, hot and cold water supply and sanitation.

32(12). The interregional fair is organized and held in accordance with the Standard for holding an interregional fair on the territory of the city of Moscow.

The standard for holding an interregional fair on the territory of the city of Moscow is approved by a legal act of the Department of Trade and Services of the city of Moscow and provides requirements for:

Arrangement of the interregional fair site;

Organizing the placement of containers for solid waste and biological waste on the site and ensuring their removal;

Ensuring electricity supply, water supply and sanitation, heating, ventilation and air conditioning of trade, warehouse, service areas and fire and sanitary rules for the fair, cleaning work for cleaning and maintaining the interior and surrounding areas;

Providing security measures for the interregional fair.

32(13). The organizer of the interregional fair determines its operating mode and also ensures the connection (technological connection) of the interregional fair site to the engineering and technical support networks.

VI. The procedure for organizing a specialized fair

33. The executive authority of the city of Moscow, including at the request of business entities who intend to organize a specialized fair, applies to the Department of Trade and Services of the city of Moscow to prepare a draft legal act of the Department of Trade and Services of the city of Moscow on the organization and holding of a specialized fair.

Specialized fairs, organized by the executive authorities of the city of Moscow, are held on land plots that are state owned by the city of Moscow or the state ownership of which is not demarcated.

Specialized fairs, organized by legal entities and individual entrepreneurs, are held on land plots owned by them by right of ownership or other right, subject to the use of these land plots in accordance with their intended purpose.

34. The legal act of the Department of Trade and Services of the city of Moscow on the organization and holding of a specialized fair defines:

- specialization of the fair;

- fair organizer;

- address (location) of the fair site;

- period(s) of the fair;

- a list of groups of goods to be sold at a specialized fair, as well as a list of work performed and services provided;

- information on the criteria for participation in a specialized fair (if any) and the procedure for selecting fair participants.

The procedure for establishing, determining the amount and collecting fees for the provision of places for selling goods (performing work, providing services) is determined by the organizer of the specialized fair independently.

35. After the adoption of a legal act by the Department of Trade and Services of the city of Moscow on the organization and holding of a specialized fair, the organizer of the fair, within 10 calendar days, develops an action plan for organizing the fair and selling goods (performing work, providing services) at it, and also determines the operating hours of the fair , the procedure for organizing the fair, the procedure for providing places for the sale of goods (performance of work, provision of services) at the fair. Information about the plan of events for organizing the fair and selling goods (performing work, providing services) at it is published by the organizer of the fair in the media.

VII. Requirements for places for selling goods (performing work, providing services) at fairs

36. Places for selling goods (performing work, providing services) at each fair site must be of the same type, unless otherwise provided by this Procedure.

37. Specialized vehicles can be used for trade at the fair site, subject to state registration of these vehicles and their technical inspection in the manner prescribed by law.

38. When using measuring instruments (scales, weights, measuring containers and other devices), cash register equipment, conditions for their installation must be provided on site in accordance with metrological rules and technical requirements.

Scales and other measuring instruments must be installed on site in such a way that customers can visually check the measure and weight of purchased goods.

39. The place for selling goods (performing work, providing services) must be provided with trade, technological and refrigeration equipment, ensuring the ability to comply with the conditions for receiving, storing and dispensing goods, as well as the necessary inventory.

The equipment and inventory used must be kept in good condition, meet the requirements for electrical and explosion safety and ensure the ability to comply with fire safety standards and regulations, as well as the possibility of emergency evacuation of people and material assets in the event of emergencies or emergencies.

40. At each place for the sale of goods (performance of work, provision of services) on the fair site, convenient for viewing by buyers, an information plate must be placed indicating the name of the fair participant and the place of origin of the goods.

VIII. Requirements for organizing the sale of goods (performance of work, provision of services) at fairs

41. The sale of goods (performance of work, provision of services) at fairs is carried out if the sellers have:

1) shipping documentation for the products being sold, and for citizens - heads of peasant (farm) holdings, citizens running personal subsidiary plots or engaged in gardening, vegetable farming, livestock farming - a document confirming that the citizen maintains a peasant (farming) holding, personal subsidiary farming or occupation gardening, vegetable farming, livestock farming, as well as title documents for a land plot used for running a peasant (farm) household, personal subsidiary plot or for gardening, vegetable farming, livestock farming, or their notarized copies;

2) documents confirming the quality and safety of products in accordance with the requirements of federal legislation;

3) information about the fair participant:

- for legal entities and individual entrepreneurs - the original or a duly certified copy of the certificate of registration with the tax authority;

- for individuals - passport or other identification document;

4) medical books of the established form with complete data of medical examinations and other documents provided for by law.

5) documents confirming kinship in relation to the fair participant, or their notarized copies (if the fair participant is a citizen - the head of a peasant (farm) household, a citizen running a personal subsidiary plot or engaged in gardening, horticulture, livestock farming).

42. The documents provided for in paragraph 41 of this Procedure are stored by sellers during the entire operating time and are presented at the request of officials of authorized state bodies and the fair organizer.

43. Goods (work, services) sold at fairs must be provided with price tags.

44. Industrially produced food products must be labeled, and fruit and vegetable products must have information about the place of cultivation (production) of the product.

The price of at least one type of product provided for in the List of types of food products sold at the weekend fair must be lower by at least 10 percent than the level of average city prices established according to the data of the Territorial body of the Federal State Statistics Service for Moscow at the time of the event. weekend fairs.

IX. List of goods (works, services) to be sold at fairs

45. At weekend fairs, the sale of agricultural products and food products included in the Assortment List of goods, as well as in the List of types of food products sold at weekend fairs, which are approved by the Department of Trade and Services of the city of Moscow, produced in the territory of the member states of the Eurasian economic union, as well as fruit and vegetable products growing on the territory of the member states of the Eurasian Economic Union, produced on the territory of other states.

At weekend fairs, the sale of fruits and vegetables included in the lists approved by the Department of Trade and Services of the city of Moscow that do not grow on the territory of the member states of the Eurasian Economic Union, as well as the sale of non-food products, is not allowed.

46. ​​At regional fairs, the sale of agricultural products, food products and non-food products of light industry, folk arts and crafts, handicraft products produced in the territory of the declared constituent entities of the Russian Federation, member states of the Eurasian Economic Union, including products of members of industry associations is carried out.

46(1). At interregional fairs, the sale of agricultural products and food products produced or growing in the territory of the declared constituent entities of the Russian Federation and member states of the Eurasian Economic Union is carried out.

47. At weekend fairs, regional and interregional fairs, the sale of:

- alcoholic and alcohol-containing products;

- perfumery and cosmetic products;

- tobacco products;

- audio, video products, computer information media, household appliances;

- products from fur raw materials and tanned sheepskin, animal skins;

- animal meat, poultry and non-industrial slaughter products;

- canned products, culinary products from meat and fish, confectionery products prepared at home;

- meat and fish semi-finished products of non-industrial production;

- unpackaged gastronomic products;

- baby food;

- household chemical goods;

- animals;

- medicines and medical products;

- products made of precious metals and precious stones;

- other goods, the sale of which is prohibited or limited by the legislation of the Russian Federation;

- produced on the territory of states that are not members of the Eurasian Economic Union, included in the lists of fruits and vegetables approved by the Department of Trade and Services of the city of Moscow, not growing on the territory of member states of the Eurasian Economic Union.

48. The list of groups of goods to be sold at specialized fairs, as well as the list of work performed and services provided at specialized fairs, are determined on the basis of the legal act of the Department of Trade and Services of the City of Moscow on the organization and holding of a specialized fair.

X. Control over the organization of fairs and the sale of goods (performance of work, provision of services) at them

49. Control over compliance by legal entities, individual entrepreneurs, and citizens with the requirements for organizing the sale of goods (performance of work, provision of services) at fairs is carried out by the executive authorities of the city of Moscow, as well as federal executive authorities within the limits of the powers granted.

50. The Moscow Department of Trade and Services monitors compliance with the requirements for organizing and holding weekend fairs and ensures coordination of activities to eliminate identified violations.

51. Councils of deputies of municipal districts monitor the work of weekend fairs.

The subject of monitoring is compliance with the requirements for organizing the fair:

- location and number of places for selling goods (performing work, providing services);

- the absence of goods whose sale at weekend fairs is prohibited;

- availability of standard commercial and technological equipment, dry closets if necessary;

- sanitary condition of the fair, cleaning of the fair site, removal of garbage and biological waste.

The procedure for the participation of deputies of the council of deputies of a municipal district in monitoring is determined by the council of deputies of the municipal district. The head of the municipal district sends the monitoring results to the State Budgetary Institution of the City of Moscow "Moscow Fairs" and to the Department of Trade and Services of the City of Moscow.

If there are comments on the organization of the fair in the monitoring results, the State Budgetary Institution of the City of Moscow "Moscow Fairs" within 10 working days from the date of receipt of the monitoring results sends a response about the consideration of the monitoring results and the measures taken to the head of the municipal district and to the Department of Trade and Services of the city of Moscow.

XI. Elimination of conflict situations that arise during the organization and conduct of weekend fairs

52. To consider conflict situations that arise between fair organizers, fair participants and other persons during the organization and conduct of weekend fairs, a conflict commission is created at the Moscow Department of Trade and Services. The regulations on the conflict commission are approved by legal act by the Department of Trade and Services of the city of Moscow.
