On amendments to the Town Planning Code of the Russian Federation and certain legislative acts of the Russian Federation

Article 1

16) Article 55.5 shall be stated as follows:

"Article 55.5. Standards and internal documents of a self-regulatory organization

1. Before entering information about it into the state register of self-regulatory organizations, a non-profit organization is obliged to develop and approve the documents provided for by the legislation of the Russian Federation on non-profit organizations and the Federal Law “On Self-Regulatory Organizations”, as well as the following internal documents of the self-regulatory organization:

1) on the compensation fund for damages;

2) on the compensation fund for securing contractual obligations (in the cases provided for in parts 2 and 4 of Article 55.4 of this Code);

3) on the register of members of a self-regulatory organization;

4) on the procedure for considering complaints about the actions (inaction) of members of the self-regulatory organization and other appeals received by the self-regulatory organization;

5) on the self-regulatory organization conducting an analysis of the activities of its members based on the information provided by them in the form of reports;

6) on membership in a self-regulatory organization, including on the requirements for members of a self-regulatory organization, on the amount, procedure for calculating and paying the entrance fee, membership fees.

2. A self-regulatory organization may develop and approve internal documents:

1) on insurance by members of a self-regulatory organization of the risk of civil liability that may occur in the event of harm due to deficiencies in work that affect the safety of capital construction projects, on the conditions of such insurance;

2) on insurance of the risk of liability for violation by members of a self-regulatory organization of the terms of a contract for engineering surveys, for the preparation of design documentation, a construction contract, as well as the terms of such insurance;

3) other internal documents.

3. Internal documents of a self-regulatory organization, provided for in parts 1 and 2 of this article, cannot contradict the legislation of the Russian Federation and the charter of a non-profit organization.

4. A self-regulatory organization in the course of its activities, in addition to the standards provided for by the Federal Law “On Self-Regulatory Organizations” (hereinafter referred to as the standards of a self-regulatory organization), within a period of no later than three months from the date of assignment of the status of a self-regulatory organization, approves the qualification standards of the self-regulatory organization in the relevant field of activity .

5. Qualification standards of a self-regulatory organization are internal documents of a self-regulatory organization and determine the qualification characteristics (required level of knowledge and skills, level of independence in performing a job function, differentiated depending on the area of ​​activity) necessary for employees to carry out job functions of performing engineering surveys, preparing design documentation, construction, reconstruction, major repairs of capital construction projects.

6. The requirements for members of a self-regulatory organization established in the standards of the self-regulatory organization and in the internal documents of the self-regulatory organization cannot be lower than the minimum established in this part:

1) qualification requirements for individual entrepreneurs, as well as managers of a legal entity, independently organizing the implementation of engineering surveys, preparation of design documentation, construction, reconstruction, major repairs of capital construction projects - the presence of a higher education in the relevant field and work experience in the specialty of at least five years ;

2) requirements for an individual entrepreneur or legal entity to have specialists in organizing engineering surveys (chief project engineers), specialists in organizing architectural and construction design (chief project engineers, chief project architects), specialists in organizing construction (chief project engineers), labor whose function includes, respectively, organizing the execution of engineering survey work, the execution of work on the preparation of design documentation, construction work, reconstruction, major repairs of capital construction projects and information about which is included in the national registers of specialists provided for in Article 55.5-1 of this Code (hereinafter also referred to as - specialists) - at least two specialists at the place of main work.

7. The requirement for the minimum number of specialists of an individual entrepreneur or legal entity at the place of main work may be increased by a self-regulatory organization, including if it is necessary for such specialists to perform a labor function, including organizing the execution of engineering survey work, the preparation of project documentation in relation to cultural heritage sites for the purpose of preservation of such objects, as well as, if necessary, the implementation of labor functions by such specialists, including the organization of work on engineering surveys, preparation of design documentation, construction, reconstruction, major repairs of capital construction projects, depending on their technical complexity and potential danger, on the cost of one contract agreements for engineering surveys, preparation of design documentation, construction contracts.

8. Requirements for members of a self-regulatory organization performing engineering surveys, preparing design documentation, construction, reconstruction, major repairs of particularly dangerous, technically complex and unique objects, differentiated taking into account the technical complexity and potential danger of such objects, are established in the internal documents of the self-regulatory organization and cannot be lower than the minimum established by the Government of the Russian Federation.

9. The standards of a self-regulatory organization and internal documents cannot contradict this Code, the legislation of the Russian Federation on technical regulation, as well as standards for the processes of performing engineering survey work, preparing project documentation, construction, reconstruction, major repairs of capital construction projects, approved by the relevant National Association self-regulatory organizations.

10. The standards of a self-regulatory organization and internal documents of a self-regulatory organization are approved by the permanent collegial governing body of the self-regulatory organization, with the exception of internal documents, the approval of which falls within the exclusive competence of the general meeting of members of the self-regulatory organization. The standards of a self-regulatory organization and internal documents of a self-regulatory organization are mandatory for all its members, their specialists and other employees.

11. The procedure for developing standards of a self-regulatory organization and internal documents of a self-regulatory organization is determined by the self-regulatory organization independently in compliance with the requirements established by this article.

12. Internal documents of a self-regulatory organization, provided for in parts 1 and 4 of this article, the development and approval of which by a self-regulatory organization are mandatory; changes made to such documents, decisions to invalidate such documents come into force no earlier than from the date information about them is entered to the state register of self-regulatory organizations in accordance with Part 5 of Article 55.18 of this Code.

13. Internal documents of a self-regulatory organization provided for in Part 2 of this article, changes made to these documents, decisions to recognize such documents as invalid shall come into force no earlier than ten days after the day of their adoption.

14. Internal documents of a self-regulatory organization provided for in parts 1, 2 and 4 of this article, changes made to these documents, decisions made by the permanent collegial management body of a self-regulatory organization are subject to posting within no later than three working days from the date of their adoption on the website of this self-regulatory organization on the Internet and in the direction (with the exception of decisions made by the permanent collegial management body of the self-regulatory organization in relation to members of the self-regulatory organization) on paper or in the form of electronic documents (a package of electronic documents) signed by the self-regulatory organization using enhanced qualified electronic signature, to the supervisory authority for self-regulatory organizations.";

17) add Article 55.5-1 with the following content:

"Article 55.5-1. Specialists in organizing engineering surveys, specialists in organizing architectural and construction design, specialists in organizing construction

1. A specialist in organizing engineering surveys, a specialist in organizing architectural and construction design, a specialist in organizing construction is an individual who has the right to carry out, under an employment contract concluded with an individual entrepreneur or legal entity, labor functions in organizing the execution of engineering survey work, preparation of design documentation, construction, reconstruction, major repairs of a capital construction project in the position of chief engineer of the project, chief architect of the project and information about which is included in the national register of specialists in the field of engineering surveys and architectural and construction design or in the national register of specialists in the field of construction.

2. Specialists in the organization of engineering surveys, specialists in the organization of architectural and construction design, information about which is included in the national register of specialists in the field of engineering surveys and architectural and construction design, are engaged by an individual entrepreneur or a legal entity under an employment contract in order to organize the execution of work according to engineering surveys, preparation of design documentation.

3. The job responsibilities of specialists in organizing engineering surveys and specialists in organizing architectural and construction design include, respectively:

1) preparation and approval of assignments for the performance of engineering survey work, assignments for the preparation of design documentation for a capital construction project;

2) determining criteria for selecting participants in the work of performing engineering surveys, preparing design documentation and selecting performers of such work, as well as coordinating the activities of performers of such work;

3) presentation, approval and acceptance of the results of work on performing engineering surveys and preparing design documentation;

4) approval of the results of engineering surveys and design documentation.

4. Specialists in the organization of construction, information about which is included in the national register of specialists in the field of construction, are engaged by an individual entrepreneur or a legal entity under an employment contract in order to organize the execution of work on construction, reconstruction, and major repairs of capital construction projects.

5. The job responsibilities of construction management specialists include:

1) organization of incoming control of design documentation for capital construction projects;

2) operational planning, coordination, organization and conduct of construction control in the process of construction, reconstruction, major repairs of capital construction projects;

3) acceptance of completed types and individual stages of work on construction, reconstruction, major repairs of capital construction projects, elements, structures and parts of capital construction projects, engineering support networks, their sections with the right to sign the relevant documents;

4) signing the following documents:

a) act of acceptance of a capital construction project;

b) a document confirming the compliance of the constructed or reconstructed capital construction facility with the requirements of technical regulations;

c) a document confirming the compliance of the parameters of the constructed or reconstructed capital construction facility with the design documentation, including the requirements for energy efficiency and the requirements for equipping the capital construction facility with metering devices for the energy resources used;

d) a document confirming the compliance of the constructed or reconstructed capital construction facility with the technical conditions for connection (technological connection) to engineering support networks (if any).

6. Information about the individual specified in Part 1 of this article is included by the relevant National Association of Self-Regulatory Organizations, respectively, in the national register of specialists in the field of engineering surveys and architectural and construction design, in the national register of specialists in the field of construction (hereinafter also referred to as national registers of specialists) based on the application of such a person, provided that he meets the following minimum requirements:

1) presence of higher education in a profession, specialty or area of ​​training in the field of construction;

2) the presence of work experience, respectively, in organizations performing engineering surveys, preparing design documentation, construction, reconstruction, major repairs of capital construction projects in engineering positions for at least three years;

3) having a total work experience in the profession, specialty or area of ​​training in the field of construction of at least ten years;

4) advanced training of a specialist in the field of training in the field of construction at least once every five years;

5) availability of a work permit (for foreign citizens).

7. The procedure for including information about an individual in national registers of specialists and their exclusion from such registers, as well as the list of areas of training in the field of construction, is approved by the federal executive body exercising the functions of developing and implementing state policy and legal regulation in the field of construction, architecture, urban planning.

8. The National Association of Self-Regulatory Organizations denies an individual the inclusion of information about him in the national register of specialists in the case of:

1) such person does not meet the requirements established by part 6 of this article;

2) establishing the fact of submission of documents containing false information;

3) such an individual has an outstanding or unexpunged conviction for committing an intentional crime;

4) the presence in relation to such an individual of decisions to exclude information about him from the national register of specialists on the grounds specified in paragraphs 3-5 of part 9 of this article, taken for a period of no more than three years preceding the date of filing the application specified in part 6 of this articles;

5) the presence in relation to such an individual of decisions to exclude information about him from the national register of specialists, taken for a period of at least two years preceding the date of filing the application specified in part 6 of this article.

9. Information about the individual specified in part 1 of this article is excluded from the national register of specialists:

1) based on an application from such an individual;

2) in connection with the death of such an individual (including on the basis of an application from a self-regulatory organization);

3) if, due to the fault of such an individual, payments were made from the compensation funds of a self-regulatory organization and the guilt of this specialist was established by a court (including on the basis of an appeal from a self-regulatory organization);

4) in the event that such an individual is brought to administrative responsibility two or more times for similar offenses committed during the performance of engineering surveys, preparation of project documentation in relation to one capital construction project, committed during the construction, reconstruction, major repairs of one capital construction project (in including on the basis of an appeal from a self-regulatory organization);

5) if an individual entrepreneur or a legal entity whose employee is such an individual, through the fault of such an individual, is included in the register of unscrupulous suppliers (contractors, performers) and the guilt of such an individual is established by a court (based on the application of such an individual entrepreneur or such a legal entity) ;

6) upon expiration of the foreign citizen’s temporary residence permit in the Russian Federation and the validity period of his work permit.

10. Maintaining the national register of specialists in the field of engineering surveys and architectural and construction design, the national register of specialists in the field of construction is carried out by the relevant National Association of Self-Regulatory Organizations.

11. National registers of specialists must contain the following information:

1) last name, first name, patronymic (if any) of the individual;

2) the type of work carried out by an individual (organization of work on engineering surveys, on the preparation of design documentation, on construction, reconstruction, major repairs of capital construction projects);

3) the date of the decision to include information about an individual in the national register of specialists or the date of the decision to exclude information about such an individual from the national register of specialists.

12. Information contained in the national register of specialists must be posted on the website of the relevant National Association of Self-Regulatory Organizations on the Internet and must be available for review without charging a fee.

13. The procedure for maintaining national registers of specialists, the procedure for making changes to information about individuals included in such registers, are established by the federal executive body exercising the functions of developing and implementing state policy and legal regulation in the field of construction, architecture, and urban planning." ;

Article 9

1. This Federal Law comes into force on July 1, 2017, with the exception of certain provisions of this Federal Law, for which this article provides for a different date for their entry into force.

2. Clause 7, subparagraphs "d" and "e" of paragraph 13, paragraphs 15, 28, 29, subparagraph "a", paragraphs five - seven of subparagraph "b", subparagraphs "c" and "d" of paragraph 30, paragraph 31 , subparagraph "c" of paragraph 32, subparagraphs "c" and "d" of paragraph 33 of Article 1, Article 6, Part 1 of Article 7, Parts 1, 2, 4 and 5 of Article 8 of this Federal Law come into force on the date of official publication of this Federal Law.

4. Specialists in the organization of construction, information about which is included in the national register of specialists in the field of construction, are engaged by an individual entrepreneur or legal entity under an employment contract in order to organize the execution of construction, reconstruction, major repairs, and demolition of capital construction projects.

  1. General provisions

  • the procedure for concluding and executing contracts for the creation (transfer) of scientific and technical products; economics and organization of construction;

  • rules and regulations of labor protection.

1.6. The chief engineer of the project is guided in his activities by:

  • company charter;
  • this job description;
  • regulatory materials for the design, construction and operation of facilities.

1.7. During the period of temporary absence of the chief engineer of the project, his duties are assigned to [name of the deputy position], who is appointed in the prescribed manner, acquires the appropriate rights and is responsible for failure to perform or improper performance of the duties assigned to him in connection with the replacement.

2. Job responsibilities

The chief project engineer is required to perform the following job functions:

2.7. Draws up calendar plans for the production of scientific and technical products.

2.8. Develops proposals on the composition of project developers, distributes tasks between them according to sections and parts of the project, volumes and costs of work.

2.9. Forms assignments for subcontractors to perform the work entrusted to them and provides these organizations with the necessary initial data.

2.10. Resolves issues that arise during the development of documentation.

2.11. Monitors the technical level of design, urban planning and architectural planning decisions taken, the economical expenditure of funds for design and survey work, and the timing of development of design and estimate documentation.

2.12. Guarantees compliance of the developed design and estimate documentation with state standards, norms, rules and instructions.

2.14. Protects the project in higher organizations and examination bodies.

2.17. Organizes work to eliminate detected defects in design estimates and other technical documentation, as well as to record the expenditure of approved estimates.

2.18. Prepares proposals to the management of the design organization and the customer to make changes to the working documentation related to the introduction of new regulatory documents, taking into account the actual state of construction.

2.19. Coordinates justified deviations from current norms, rules, instructions with state supervisory authorities and other organizations that have approved them.

2.20. Provides analysis and generalization of experience in the design, construction and operation of constructed facilities and preparation on this basis of proposals to improve the technical and economic level of design solutions.

2.21. Prepares reviews and conclusions on rationalization proposals and inventions, draft standards, technical specifications and other regulatory documents related to design and construction.

2.22. Takes part in the examination of projects, preparation of publications and drawing up applications for inventions, in seminars and conferences in his specialty.

In case of official necessity, the chief engineer of the project may be involved in the performance of his official duties overtime, in the manner prescribed by law.

3. Rights

The chief engineer of the project has the right:

3.1. Participate in the discussion of draft decisions of the head of the company.

3.2. Manage the financial resources and property entrusted to him in compliance with the requirements determined by legislative and regulatory legal acts and the organization’s charter.

3.3. Sign and endorse documents within your competence.

3.4. Initiate and conduct meetings on organizational, financial and economic issues.

3.6. Conduct quality checks and timely execution of orders.

3.7. Demand cessation (suspension) of work (in case of violations, non-compliance with established requirements), compliance with established norms, rules, instructions, give instructions for correcting deficiencies and eliminating violations.

3.8. Submit for consideration by the head of the company proposals on the hiring, transfer and dismissal of employees, on the encouragement of distinguished employees and on the application of disciplinary sanctions to employees who violate labor discipline.

3.9. Participate in discussions of issues related to the duties performed by him.

3.10. Require the head of the company to provide assistance in the performance of his official duties and rights.

4. Responsibility and performance evaluation

4.1. The chief engineer of the project bears administrative, disciplinary and material (and in some cases provided for by the legislation of the Russian Federation, criminal) responsibility for:

4.1.1. Failure to carry out or improperly carry out official instructions from the immediate supervisor.

4.1.2. Failure to perform or improper performance of one's job functions and assigned tasks.

4.1.3. Illegal use of granted official powers, as well as their use for personal purposes.

4.1.4. Inaccurate information about the status of the work assigned to him.

4.1.5. Failure to take measures to suppress identified violations of safety regulations, fire safety and other rules that pose a threat to the activities of the enterprise and its employees.

4.1.6. Failure to ensure compliance with labor discipline.

4.2. The assessment of the work of the chief engineer of the project is carried out:

4.2.1. By the immediate supervisor - regularly, in the course of the employee’s daily performance of his labor functions.

4.2.2. The certification commission of the enterprise - periodically, but at least once every two years, based on documented results of work for the evaluation period.

4.3. The main criterion for assessing the work of the chief project engineer is the quality, completeness and timeliness of his performance of the tasks provided for in this job description.

5. Working conditions

5.1. The work schedule of the chief project engineer is determined in accordance with the internal labor regulations established by the Company.

5.2. Due to production needs, the chief engineer of the project is required to go on business trips (including local ones).

5.3. To resolve operational issues related to ensuring production activities, the chief engineer of the project may be allocated company vehicles.

6. Signature right

6.1. To ensure his activities, the chief engineer of the project is given the right to sign organizational and administrative documents on issues within his competence by this job description.
