I. General provisions

1.1. This Regulation determines the procedure for notifying the employer about cases of inducing an employee to commit corruption offenses or about information that has become known to the employee about cases of committing corruption offenses (hereinafter referred to as the Regulations) developed in accordance with Part 5 of Article 9 Federal Law dated December 25, 2008 N273-FZ “On Combating Corruption” in order to create unified system on the prevention of corruption offenses in the SCHOOL of the city of Kirov (hereinafter referred to as the school) and determines the procedure for notifying the employer in cases of inducing an employee to commit corruption offenses or about information that has become known to the employee about cases of corruption offenses, establishes a list of information contained in these notifications, the registration procedure notifications and organization of verification of information specified in the notification, as well as the procedure for making decisions based on the results of consideration of notifications.

1.2. This Regulation applies to all SCHOOL employees.

2.2. The notification is registered in the Journal of registration of notifications about the facts of appeal in order to induce a municipal employee to commit corruption offenses (hereinafter referred to as the Journal) in the form in accordance with Appendix No. 2 to these Regulations: - immediately in the presence of the notifier, if the notification is presented by him personally; - on the day it arrived by mail or courier.

2.3. Registration of the notification is carried out by the person responsible for the prevention of corruption and other offenses, appointed for maintaining and storing the Journal in the prescribed manner. The journal must be stored in conditions that prevent access to it by unauthorized persons. The sheets of the Journal must be numbered, laced and sealed with the Administration's seal.

If it follows from the employee’s notification that he did not notify the prosecutor’s office or other government bodies about the appeal to him in order to induce him to commit corruption offenses, the employer, immediately after receiving the notification from the employee, sends a copy of it to one of the above-mentioned bodies.

2.6. If the notification contains information about a crime committed or being prepared, the verification of this notification is organized in accordance with the provisions of the criminal procedural legislation of the Russian Federation and the legislation of the Russian Federation on operational-search activities, for which the received notification is immediately sent to law enforcement agencies in accordance with their competence.

III. The procedure for organizing verification of information contained in the notification.

3.1. After registration, the notification is submitted to the school director for review.

3.2. The notification received by the school director is the basis for his decision to conduct internal audit information contained in the notification, which is formalized by the relevant order.

3.3. To carry out the inspection, by order of the school director, a commission is created, which consists of the chairman of the commission, deputy chairman, secretary and members of the commission. The commission must consist of at least 5 people.

3.4. All members of the commission enjoy equal rights in resolving issues considered at the meetings of the commission.

3.5. Personal composition The inspection commission is approved by order of the school director.

3.6. An employee who is directly or indirectly interested in its results cannot participate in the inspection. In these cases, he is obliged to contact the school director with a written application for his release from participation in this inspection.

3.7. When conducting an inspection there must be:

Explanations from the notifier and other school employees were heard;

The facts and circumstances of contacting an employee in order to induce him to commit a corruption offense were objectively and comprehensively considered;

The reasons and conditions that contributed to people turning to the employee with the aim of inducing him to commit corruption offenses have been established.

3.8. During the inspection, in addition to the notification, materials related to the facts contained in the notification are considered, including the job description and job description of the notifier, job descriptions and job descriptions of employees related to the facts contained in the notification.

Persons included in the commission and employees related to the facts contained in the notification do not have the right to disclose information that became known to them during the verification activities.

3.10. The work of the commission must be completed no later than 10 working days from the date of the decision to conduct the inspection.

IV. Results of the inspection.

4.1 Based on the results of the inspection, the commission makes a decision by a simple majority of votes of those present at the commission meeting. The decision of the commission is valid if at least 2/3 of the total composition of the commission was present at its meeting.

4.2. The decision of the commission is documented in a protocol. The minutes of the commission are signed by the chairman and secretary of the commission.

4.3. A member of the commission who does not agree with its decision has the right to express his dissenting opinion in writing, which is attached to the minutes.

4.4. If, during the inspection, the fact of an appeal to a municipal employee in order to induce him to commit corruption offenses is confirmed or signs of a corruption offense are identified in the actions of the municipal employee or other municipal employees related to the above facts, the commission prepares materials that are sent to the school director for adoption corresponding decision.

4.5. The school director, after receiving materials based on the results of the commission’s work, makes one of the following decisions within three days:

a) on the immediate transfer of inspection materials to law enforcement agencies;

b) to contact the relevant competent authorities with a request to ensure state protection measures for the employee and his family members from violence, threats and other unlawful actions in accordance with the legislation of the Russian Federation;

c) on taking organizational measures to prevent in the future the possibility of recourse to induce employees to commit corruption offences;

d) to exclude the possibility of the notifier and (or) other employees related to the facts contained in the notification making individual decisions on issues related to the likelihood of committing a corruption offense;

e) on the need to make appropriate changes to the job descriptions of employees to eliminate conditions conducive to contacting them in order to induce them to commit corruption offences;

f) on bringing the employee to disciplinary liability;

g) about the dismissal of an employee.

4.6. If, during an inspection, signs of a corruption offense are identified in the actions of a municipal employee, as provided for in Part 3 of Article 9 of the Federal Law of December 25, 2008 N273-FZ “On Combating Corruption,” materials based on the results of the commission’s work are sent by the school director to the relevant authorities to attract the school employee to other types of liability in accordance with the legislation of the Russian Federation.

4.7. If the fact of an appeal to a school employee with the aim of inducing him to commit corruption offenses is denied, the school director makes a decision to take note of the results of the inspection.

4.8. Information about the decision based on the results of the inspection is included in the personal file of the notifier.

4.9. The school employee in respect of whom the information contained in the notification is being checked, upon completion of the check, has the right to familiarize himself with a written conclusion about its results.
