Entrepreneurs are required to submit a number of reporting forms to the Organization of Federal Statistical Observation based on the results of their work; there may also be a need to submit reports to Rosstat in 2019 for individual entrepreneurs. At the end of 2017, the statistics agency issued an order listing reporting forms for legal entities: there are 23 positions in total, but, fortunately, not all of them are required for individual entrepreneurs.

Registration of individual entrepreneurs in statistics is required by Rosstat to collect information about the work of legal entities and individual entrepreneurs. To do this, the individual entrepreneur receives a letter from Rosstat containing statistical codes related to his activities.

What are they needed for:

  • provision of accounting, tax, and other reporting documents;
  • issue payments and receipts;
  • opening a bank account by a businessman;
  • official submission of statistical reporting (more on this will be discussed below);
  • export-import operations;
  • opening new branches of the company;
  • change of region of registration of an individual entrepreneur;
  • change of individual name;
  • in a number of other cases.

But more than one state needs Rosstat’s information.

Statistical observations of the activities of business entities, summarized in an analytical report, are used by marketers, private and corporate investors, financial institutions and other authorities.

To find out your state numbers, you can go in two ways:

  1. When registering a new individual entrepreneur with the Federal Tax Service, whose department operates in a “one-stop shop” format, you are allowed to ask for codes directly when submitting a package of papers.
  2. Contact Rosstat yourself, after which it will send an information letter with the information of interest.

In the second case, copies of documents will be needed from the individual entrepreneur:

  • registration certificate;
  • extract from the Unified State Register of Individual Entrepreneurs;
  • passport.

The first time Rosstat issues a notification free of charge, the repeated procedure is carried out for money. If an individual entrepreneur does not have the desire or time to obtain codes himself, you can contact specialists who, for a fee, will go through the obtaining process and help save time. In addition, you can try to find out your own statistical codes through the Rosstat website.

If the individual entrepreneur did not receive the codes upon registration, a letter is sent to him by regular mail. This is the longest method, since letters from Rosstat sometimes take up to several months.

The state statistics body does not require each individual entrepreneur to submit statistical reports: the institution makes its own internal samples, from which it selects enterprises to be inspected, and sends them notifications, after which the businessman must prepare a report in the form.

In addition, Rosstat requires individual economic entities of the Russian Federation to submit continuous observation questionnaires every five years.

Since the individual entrepreneur does not belong to legal entities, he has fewer responsibilities to the state, including in terms of statistical reporting.

Individual entrepreneur has the right:

  1. Do not prepare accounting entries.
  2. Don't do accounting.
  3. Do not prepare annual financial statements.

At the same time, accounting is carried out on a voluntary basis, for internal needs.

The individual entrepreneur, however, is obliged:

  • carry out tax accounting in accordance with the chosen taxation system;
  • take into account the indicators required for further calculation of taxes;
  • submit tax returns and reports to the Federal Tax Service;
  • maintain cash documents if cash payments are used in the work process;
  • create tax policy;
  • lead personnel documentation(if there are hired employees).
  • prepare statistical reports for submission and submit them on time if the individual entrepreneur was selected by Rosstat for the verification procedure.

The Statistics Service lists 23 reports required for submission in 2019 for those who came under inspection.

Fortunately, a significantly smaller number of individual entrepreneurs need to be submitted to Rosstat:

A businessman included in the Rosstat sample submits documents once a month, three months or a year - depending on financial indicators enterprises. More often they require you to submit quarterly reports to statistics.

It is advisable for an entrepreneur to control the need to submit documents through the Rosstat website, where the search form should be filled out in the appropriate section. The new form of reporting for individual entrepreneurs under the number 1-IP was approved by order of Rosstat at the beginning of 2017. It was introduced to standardize statistical monitoring of representatives of medium and small businesses.

The main principle of writing is the correspondence of the data entered into the form with real performance indicators.

The form for submitting an individual entrepreneur’s report to statistics is divided into several sections:

  • title page;
  • the first part with general data about the individual entrepreneur’s business;
  • paragraph of main current indicators economic activity;
  • state support paragraph.

The title page contains information about the individual entrepreneur. If the business registration address does not coincide with the actual location of the enterprise, the actual location is indicated. In addition, the OKPO code is indicated, if one is received. If it is absent, the corresponding column remains empty.

The second section contains the following information:

  • number of months worked;
  • the place where the individual entrepreneur works;
  • chosen taxation system;
  • number of employees (if any).

It is important to understand that Rosstat divides workers into three groups, which are indicated in separate columns:

  • hired employees - those with whom a written (oral) employment contract was concluded;
  • business partners - citizens who have a share in the business and do some work in it;
  • assistant family members are close relatives of the businessman who take part in the business.

Important: if relatives are hired under a contract and receive a salary, they should be classified as hired employees.

The average number of employees is calculated by adding all those working by calendar month and dividing the resulting amount by 12. The fractional result is rounded to the nearest tenth.

The second section records the performance indicators of the individual entrepreneur:

  • does it provide services to the public/companies;
  • what is the amount of revenue received for the past year;
  • provides information about fixed assets.

In cases where the individual entrepreneur provided services, acted as an intermediary, or did not provide services at all, he marks the corresponding box in the form. If there is service provision and mediation, both boxes are checked.

The revenue subsection of an individual entrepreneur records the amount earned from the sale of goods and services. In addition to the general figure, the document requires the provision of information separately for specific types of business activities.

The figures are given taking into account accrued VAT and the taxation system chosen by the individual entrepreneur:

  • when working according to OSNO - according to the procedure for accounting for expenses, income received, household expenses. enterprise operations;
  • according to the Unified Agricultural Tax - figures are taken from the Book of Accounting of Income and Expenses of an individual entrepreneur (abbreviated as KUDiR), and data from the submitted tax return Unified agricultural tax, line 010;
  • UTII - businessman gives cost products sold, taken from primary documents;
  • Simplified tax system – information from the KUDiR document and the submitted declaration according to the “simplified tax system” is indicated, section 2.1, line 113, and section 2.2, line 213;
  • PSN – KUDiR data are provided.

Should be considered:

  1. It is necessary to enter the names of the goods sold (and also write the phrase “in a store, pavilion, department”) if they are sold in stores, and indicate the corresponding OKVED.
  2. A businessman working as a wholesale intermediary indicates the amount of intermediary remuneration.

The section with fixed assets shows the price of existing assets (over 40 thousand in total) and the business costs for creating these assets.

Data about such is entered into the state support paragraph if the individual entrepreneur received state aid: financial support, informational, property assistance, consultations, support in the field of training, advanced training courses.

Submission deadlines

Deadlines for submitting reports for the 2019 reporting year:

  • according to statistical parity 1-IP: until April 1 following the year under review;
  • Form 1-IP (trading): until April 1 of the calendar year following the one for which the entrepreneur is reporting;
  • MP form: until the 4th day of the following month after the reporting month.

Also in 2019 there will be a continuous study of statistics, i.e. by April 1, all individual entrepreneurs are required to submit the specified form to Rosstat.

In addition to all of the above, the entrepreneur annually submits a document on the average number of employees if he attracts in the process of operation of the enterprise hired labor. And according to law 402-FZ, statistical authorities are provided with sample reports on financial results and balance sheet for the year.

Responsibility for failure to provide documents on activities to Rosstat individual business falls within the scope of administrative offenses and is punishable by a fine of 10-20 thousand. If the regulations are violated again, the fine increases to 30-50 thousand.

01. What is Rosstat

Organizations are required to submit:

The Federal State Statistics Service (Rosstat) is a body that generates official statistical information on social, economic, demographic and environmental situation countries.

Since April 3, 2017, Rosstat has been under the jurisdiction of the Ministry of Economic Development Russian Federation. The statistics service is designed to collect and analyze information. It's about about the formation of an information base on the basis of which it is possible to make reasonable management decisions. It is approximately comparable to information base enterprises, but on a national scale. This information is needed by authorities to improve tax, customs, and investment policies. According to statistics, you can understand how high the tax burden is on enterprises, what state this or that industry is in, how the state is developing, how the situation in certain areas of life is improving or worsening.

The activities of Rosstat are regulated by the Federal Law "On official statistical accounting and the system of state statistics in the Russian Federation" dated November 29, 2007 No. 282-FZ.

B. Selective observation carried out periodically and continuously. The composition of the reporting may change from year to year. The most common forms submitted by small and micro enterprises and individual entrepreneurs are 1-IP, MP (micro) - in kind, PM, TZV-MP, etc. The basis for their confirmation is logically financial statements, the data from which will come from the Federal Tax Service.

03. Who should report to Rosstat

Statistical reports must be submitted (Article 5 No. 209-FZ):

  1. bodies of state power and local self-government;
  2. legal entities of the Russian Federation;
  3. individual entrepreneurs;
  4. branches and representative offices of Russian organizations.

Further we are talking only about 2-4 categories of accountable persons. So, the law distinguishes small, medium and big business, who is required to submit statistical reports. Who is a small business? The law defines the categories for classifying companies and individual entrepreneurs as small and medium-sized businesses (with Vol. 4 Categories). The basic requirements are:

  • Share of participation of other Russian legal entities in the authorized capital of LLC cannot be higher than 25%, and the share foreign companies - 49 % ;
  • The number should not exceed the limits specified by law: for micro-enterprises no more than 15 people, for small - the maximum allowable value is 100 people, for medium - no more than 250 people;
  • Annual income should not exceed the limits: micro-enterprises - 120 million rubles; small enterprises - 800 million rubles; medium-sized enterprises - 2 billion rubles (Resolution of the Government of the Russian Federation dated April 4, 2016 No. 265).

Companies that are not small and medium-sized businesses submit basic statistical reporting and additional reporting, which depends on the area of ​​activity. 04. How to find out about reporting to Rosstat using the TIN

It’s easy to get a list of reports to Rosstat for your enterprise:

05. Fines

If statistical reports are not submitted to Rosstat or are not submitted on time, the fine for the organization is 20-70 thousand rubles, for the manager 10-20 thousand rubles. (Article 13.19 of the Code of Administrative Offenses of the Russian Federation).

The statute of limitations is 2 (two) years. A resolution on the imposition of an administrative penalty is not subject to execution if this resolution has not been enforced within 2 (two) years from the date of its entry into force (Article 31.9 of the Code of Administrative Offenses of the Russian Federation).

How to use the new service?

The entrepreneur must enter his OKPO and TIN codes, as well as his state registration number (OGRN or OGRNIP). After this, a list of mandatory reporting forms is downloaded to the user’s computer automatically. The same table provides the frequency and deadline for submitting reports, as well as links to Rosstat pages where you can download their forms for filling out for free. The system works even if the user entered only one of the above search parameters, however, in this case, the list of reports may be incorrect.

Why does the information on statreg.gks.ru change: one day one, two days later another? Is this related to the update system? How does it update?

The information retrieval system was developed in 2016 in order to promptly inform business entities about their provision of statistical reporting forms. The list of federal statistical observation forms posted in the specified system for respondents is compiled as of the end of the year preceding the reporting year, with its monthly updating. The monthly updating of lists of forms in the system is due to ongoing structural changes in business entities (liquidation of enterprises, creation of new ones, reorganization, change in the status of an organization, etc.), as well as the frequency of providing statistical reporting forms (monthly, quarterly, semi-annual). Considering the importance of this service for respondents, in the first half of 2017 Rosstat will make significant improvements to the interface aimed at optimizing and increasing the stability of its operation.

Why are “unnecessary” forms included in the lists on statreg.gks.ru? What should companies do?

Lists of federal statistical observation forms to be submitted by respondents are formed on the basis of statistical methodology, taking into account the types of economic activities of the organization, including all those declared at state registration. A number of federal statistical observation forms, according to instructions for filling them out, are provided only in the presence of an observed event. Providing “zero” reports for the reporting period on such forms is not required, and the absence of a report is qualified as the absence of a phenomenon by the respondent. According to federal statistical observation forms, the instructions for filling which do not contain a requirement to provide data only if a phenomenon exists, it is possible for respondents to inform the territorial bodies of Rosstat in the constituent entities of the Russian Federation official letter about the absence of indicators for specific forms of statistical reporting instead of providing “zero” reports (in the absence of a phenomenon).

Which companies does Rosstat send letters with a list of reports to? To those who were included in the sample?

Organizations included in sample surveys may be notified in writing by state statistics bodies about the provision of specific forms of federal statistical observation. If the list of reporting forms published for the respondent at statreg.gks.ru differs from the one sent to the organization in writing, the written notification should be followed. If it is necessary to clarify questions about filling out and submitting federal statistical observation forms, organizations can contact the territorial body of Rosstat in the constituent entity of the Russian Federation at the location of the organization.

What should companies do to avoid fines? Should I contact the statistics agency in writing? How to prove that we did not miss the deadline, but did not know about the report, since it was not on statreg.gks.ru?

If the organization is not on the list published on statreg.gks.ru, penalties under Article 13.19 of the Code of Administrative Offenses of the Russian Federation are not applied, except in cases where the respondent, in the manner provided for in paragraph 4 of the Regulations, was informed (including in writing) about carrying out federal statistical observation in relation to him according to specific forms of federal statistical observation mandatory for submission. "Screenshots" are only valid evidence if they contain certain data, i.e. they indicate the date and time of receipt of information from the site on the Internet, contain data about the person who displayed it on the screen and subsequently printed it, data about software and used computer technology, name of the site, affiliation with the applicant.
